1 <br /> CITY OF EVERETT PUBLIC WORKS DOCUMENT 00 21 13 <br /> SPECIAL PROVISIONS INSTRUCTIONS TO BIDDERS <br /> B. The City, in its sole discretion, reserves the right to accept or reject any and all bids submitted <br /> and to waive informalities and minor irregularities. 111 <br /> 1.22 BID PROTESTS I <br /> A. All protests by Bidders must be in accordance with Everett Municipal Code 3.46, "Bid Protest <br /> Procedures." I <br /> 1.23 PRE-AWARD CONFERENCE <br /> A. After Bid opening, but prior to award, the apparent successful Bidder shall, if requested by the <br /> City, attend a pre-award conference to respond to questions by the City regarding evaluation of <br /> Bids. <br /> 1. The City will emphasize items such as insurance and bonding that will assist in prompt <br /> issuance of the Notice to Proceed. <br /> 2. By conducting a pre-award conference, the City has not thereby waived its right to make <br /> determinations regarding responsiveness and responsibility of the Bidder. <br /> 1.24 ACCEPTANCE OF BID I <br /> A. Within 45 days after the opening of Bids, the City will act either to accept the Bid from the <br /> lowest responsive,responsible Bidder,or to reject all Bids. <br /> 1. The City reserves the right to request extensions of such Bid acceptance period. <br /> B. After acceptance by Owner, City's Project Manager, on behalf of Owner, will issue to the <br /> accepted Bidder a written Notice of Award of Contract. <br /> 1. Notice of Award of Contract will be delivered in person or by certified mail to the Bidder <br /> whose Bid is accepted. <br /> 2. Notice of Award of Contract will also include a request to furnish a performance and <br /> payment bond and evidence of insurance and to execute the Contract set forth in the <br /> Contract Documents. <br /> C. Notwithstanding delay in the preparation and execution of the Contract, accepted Bidder shall I <br /> be prepared, upon written Notice to Proceed, to commence Work within seven calendar days <br /> following receipt of official written order of Owner to proceed, or on date stipulated in such <br /> order. I <br /> D. Bidder has 14 calendar days after receiving the Notice of Award to submit the following <br /> documents to the City: <br /> 1. Two(2)executed copies of the Contract. <br /> 2. Contract bond or equivalent performance and payment bond per DOCUMENT 007213, <br /> Part 15.2"Bonds",of the Contract Documents. <br /> 3. Certificate of Insurance and additional insured endorsement, DOCUMENT 007213, Part <br /> 15.3 "Insurance", of the Contract Documents. <br /> E.
