Reference to standards, specifications, manuals, or codes of any technical society, organization, <br /> or association, or to Laws or Regulations, whether such reference be specific or by implication, <br /> shall mean the standard, specification, manual, code, or Laws or Regulations in effect at the time <br /> of opening of Bids (or on the Effective Date of the Agreement if there were no Bids), except as <br /> may be otherwise specifically stated in the Contract Documents. <br /> E. No provision of a standard, specification, manual or code, or an instruction of a Supplier shall be <br /> effective to change the duties or responsibilities of Owner, Contractor, or Owner's <br /> Representative, or their Subcontractors, consultants, agents, or employees from those set forth in <br /> the Contract Documents. No such provision or instruction shall be effective to assign to Owner, <br /> or Owner's Representative, or their related entities, any duty or authority to supervise or direct <br /> the performance of the Work or any duty or authority to undertake responsibility inconsistent <br /> with the provisions of the Contract Documents. <br /> 2.2 Division of Specifications and Drawings <br /> A. Specifications and Drawings are divided into groups for convenience. These divisions are not for <br /> the purpose of apportioning Work or responsibility for Work among Subcontractors, Suppliers and <br /> manufacturers. The Contractor is responsible for all Work shown or described, regardless of <br /> location(s)in the Contract Documents. <br /> 2.3 Discrepancies in Specifications and Drawings <br /> A. Errors and Omissions <br /> 1. If the Contractor, in the course of the Work,becomes aware of any errors or omissions in the <br /> Contract Documents or in the Owner's field work, he or she shall immediately inform the <br /> Owner's Representative in writing. The Owner's Representative will promptly review the <br /> matter and if he or she finds an error or omission has been made, then he or she will <br /> determine the corrective actions and advise the Contractor accordingly. If the corrective <br /> work associated with an error or omission significantly increases or decreases the amount of <br /> 111 Work called for in the Contract, the Owner will issue an appropriate Change Order. After <br /> discovery by the Contractor of an error or omission, related work performed by the <br /> Contractor shall be done at its risk unless authorized by the Owner's Representative and <br /> approved by the Owner. Omissions from the Drawings or Specifications or the <br /> misdescription of details of Work that are manifestly necessary to carry out the intent of the <br /> Drawings and Specifications, or that are customarily performed, shall not relieve the <br /> Contractor from performing such omitted or misdescribed details of the Work,but they shall <br /> be performed as if fully and correctly set forth and described in the Drawings and <br /> Specifications. <br /> B. Conflicting Provisions <br /> 1. Figure dimensions on drawings shall govern over scale dimensions and detail drawings shall <br /> govern over general drawings. In the event an item of Work is described differently in two <br /> or more locations on the Drawings and in the Specifications, the Contractor shall, upon <br /> request of the Owner's Representative, submit in writing to the Owner's Representative the <br /> description upon which the Contractor relied in preparing its Bid or laying out the Work. If <br /> the Owner's Representative directs the Contractor to perform Work in a manner other than <br /> that contemplated by the Contractor in preparing its Bid or laying out the Work, Change <br /> Order procedures will be followed.
