eligible for such an exemption, the Contractor shall apply for the exemption in accord <br /> with the terms of section 3.6. <br /> 12.1 Concurrent Responses: In the event three or more units are simultaneously <br /> committed to one incident and two or more additional units are concurrently responding <br /> to at least two other separate incidents, EFD may grant an exemption for each unit <br /> starting with the third incident. <br /> 12.2 Declared disaster: In the event an emergency is officially declared, EFD may <br /> grant exemption to liquidated damages resulting from response time performance <br /> standards for all units during the declared emergency. <br /> 12.3 Multiple Unit Response: In the event two or more units are simultaneously <br /> committed to one incident, the first arriving unit shall be held to the response time <br /> standard. EFD may grant an exemption for each unit starting with the second unit <br /> provided the units arrive at the scene within 19:59 minutes. <br /> 12.4 Response Location Errors: In the event EFD provides an inaccurate address, or if <br /> the location does not exist, EFD shall grant a response time exemption. <br /> 12.5 Response Location Change: In the event EFD changes the incident location and <br /> the change delays the unit's response time because the unit must reroute farther than <br /> one city block to respond to the call, EFD may grant an exemption. <br /> 12.6 Canceled Request: In the event a request is canceled prior to or at the unit's <br /> arrival on scene for reasons other than exceeding the maximum response time <br /> standard, EFD may grant an exemption. <br /> 12.7 Response Delayed by Accident: In the event the unit is involved in an accident <br /> and cannot continue to respond to the call, EFD will grant an exemption provided the <br /> accident is not the fault of the ambulance unit. <br /> 12.8 Reduced/Upgraded Response: In the event EFD reduces the priority of the <br /> response from Code to Non-Code or upgrades the response from Non-Code to Code, <br /> the response shall be considered a Non-Code response. <br /> 13.0 Invoicing and Payment of Liquidated Damages <br /> No more frequently than monthly and at least quarterly, the City shall invoice Contractor <br /> for any liquidated damages assessed during the prior period. The Contractor shall pay <br /> the liquidated damages within 30 days of receipt of invoice. <br /> 13.1 Appeal of Liquidated Damages Assessment <br /> In instances when the City's Contract Administrator, at the request of the Contractor, <br /> has reviewed the circumstances for imposing liquidated damages, and determined that <br /> the grounds are sufficient to justify the imposition of the liquidated damages, the <br /> Contract Administrator shall report the Contractor's appeal and the reasons for denial to <br /> 18 of 34 <br />
