<br /> AN ORDINANCE Relating to Drug Paraphernalia, Amending Sections 2, 3
<br /> and 4 of Ordinance No. 1653-89 (EMC 10.35.020, 10.35.030 and 10.35.040) and
<br /> Section 1 of Ordinance No. 2318-98 (EMC 10.35.055).
<br /> WHEREAS, in 2002 the Legislature of the State of Washington added an exemption to
<br /> the state Drug Paraphernalia crimes, authorizing the sale and possession of hypodermic
<br /> syringes and needles to reduce the transmission of bloodborne diseases; and
<br /> WHEREAS, the City of Everett City Council deems it appropriate for the City Criminal
<br /> Code to be consistent with state law in this area;
<br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
<br /> Section 1: Section 2 of Ordinance No. 1653-89 (EMC 10.35.020), which reads as
<br /> follows:
<br /> Possession of drug paraphernalia.
<br /> It is unlawful for any person to use, or possess with intent to use, drug paraphernalia to
<br /> plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce,
<br /> process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale
<br /> or otherwise introduce into the human body a controlled substance, as defined by Chapter
<br /> 69.50 RCW, as now or hereafter amended. Any person who violates this section is guilty
<br /> of a misdemeanor.
<br /> is hereby amended to read as follows:
