C. The sale or dispensing or consumption of intoxicating liquors on City park <br /> property shall be limited to the concessionaire's premises only; provided <br /> however, the concessionaire is permitted to sell beer and wine on the golf <br /> courses and such beer and wine sold may be consumed on the golf courses as <br /> well. Possession of an open container of intoxicating liquor or consumption <br /> of liquor at any location other than on the golf courses as authorized herein or <br /> on the premises of duly licensed concessionaires to whom the privilege to sell <br /> beer and wine is authorized herein is unlawful. <br /> D. All beer and wine sold on City-owned golf courses shall be in containers <br /> opened at the time and point of sale and shall not be taken onto the parking <br /> lot. <br /> E. The sale of beer and wine by authorized concessionaires shall be permitted <br /> upon execution of a modification of the contract between the City and such <br /> concessionaires increasing the City's percentage share of revenues from <br /> beverage cart alcohol sales from thirty five percent (35%) to forty five percent <br /> (45%). <br /> F. On or before September 1, 2003, the Parks Department shall provide the City <br /> Council with a report concerning the effect of beer and wine sales by beverage <br /> cart operators on the operations of City-owned golf courses. <br /> G. This ordinance shall expire on September 15, 2003, unless the City Council <br /> (by a majority vote of four(4)) determines to extend it. <br /> SECTION 2: Savings. <br /> Nothing contained herein shall be construed as abating any action now pending <br /> under or by virtue of any ordinance of the City; or as discontinuing, abating, <br /> modifying or altering any penalty accrued or to accrue, or as affecting the right or <br /> liability of any person, firm or corporation, or as waiving any right of the City <br /> under any ordinance or provision thereof in force at the time of passage of this <br /> ordinance. <br /> SECTION 3: Validity. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this <br /> ordinance or its application to any person or situation be declared unconstitutional <br /> or invalid for any reason, such decision shall not affect the validity of the <br /> remaining portions of this ordinance or its application to any other person or <br /> situation. The City Council hereby declares that it would have adopted this <br /> ordinance and each section, subsection, sentence, clause, phrase or portion thereof <br /> irrespective of the fact that any one or more section, subsection, sentences, <br /> clauses, phrases or portions be declared invalid or unconstitutional. <br /> SAUIIes\WINWORD\ordinance golf alcohol.doe 2 <br />
