Casino Road to R-3 Multiple Family Medium <br /> Density Residential and Confirming Compliance with the Terms of <br /> Resolution No. 3592 as amended. <br /> WHEREAS, John Price, represented by Greg Blount/Driscoll Architects applied for a rezone of <br /> property located at 310 W. Casino Road, the legal description of which is: <br /> Tracts 25 and 26, Beverly Homesites, Division 1, according to the Plat <br /> thereof recorded in Volume 10 of Plats, page 74, in Snohomish County <br /> Washington; except the south 35 feet of said Tract 25; and except the <br /> following parcel of land in said Tract 26; Beginning at a point 20 feet north <br /> of the southwest corner of said Tract 26; thence south 20 feet; thence east 40 <br /> feet; thence northwesterly 45 feet; more or less, to the point of beginning; <br /> also, except portion condemned by the State of Washington of State <br /> Highway SR-526 under Court Cause No. 93010 of the Superior Court of <br /> Snohomish County, State of Washington; and except that portion conveyed <br /> to the City of Everett by deed recorded under Recording Number <br /> 8303280307 <br /> for the purpose of constructing a 33 unit apartment development; and <br /> WHEREAS, the City Council did pass Resolution No. 3592 on January 29, 1992, which declared <br /> the City's Intent to Rezone the subject property from R-3PRD to R-3 Multiple Family <br /> Residential for the purpose of developing a 36 unit apartment complex and granting a height <br /> variance upon compliance with the terms and conditions of the Resolution; and <br /> WHEREAS, the City Council did pass Resolution No. 4351 on November 6, 1996, amending <br /> Resolution No. 3592 for the purpose of developing a 33 unit apartment complex, granting a <br /> height variance and buffer width reduction revision and to allow the zoning to revert to R-3 <br /> rather than R-3PRD if the Intent to Rezone expires. In addition to these amendments, Resolution <br /> No. 4351 also granted a 5-year extension of the Intent to Rezone Resolution No. 3592 upon <br /> compliance with the terms and conditions of the resolution; and <br /> WHEREAS, development of the subject property was substantially completed in accordance <br /> with the terms and conditions of Resolution No. 3592, as amended by Resolution No. 4351, <br />
