however construction was not fully completed prior to the expiration date of January 29, 2002, <br /> as set forth by Resolution No. 4351; and <br /> WHEREAS, in the summer of 2002, the City Council did further amend Resolution No. 3592 <br /> granting a one year extension; and <br /> WHEREAS,the City Council finds that: <br /> 1. The rezone is consistent with the Everett General Plan. <br /> 2. The rezone bears a substantial relation to the public health, safety, and welfare; <br /> and promotes the best long-term interests of the Everett community. <br /> 3. The terms of the Resolution that limit the use of the property and establish <br /> standards for the development of the area proposed to be rezoned, are sufficient to <br /> mitigate adverse impacts upon existing or anticipated land uses in the immediate <br /> vicinity of the subject property; and <br /> WHEREAS, John Price,represented by Greg Blount/Driscoll Archictects has now fully <br /> complied with the terms of the Resolution of Intent to Rezone Resolution No. 3592, as amended; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: The zoning of the property located at 310 W. Casino Road, Everett, Washington <br /> which is legally described below is hereby amended to R-3 Multiple Family Residential: <br /> Tracts 25 and 26, Beverly Homesites, Division 1, according to the Plat <br /> thereof recorded in Volume 10 of Plats, page 74, in Snohomish County <br /> Washington; except the south 35 feet of said Tract 25; and except the <br /> following parcel of land in said Tract 26; Beginning at a point 20 feet north <br /> of the southwest corner of said Tract 26; thence south 20 feet; thence east 40 <br /> feet; thence northwesterly 45 feet; more or less, to the point of beginning; <br /> also, except portion condemned by the State of Washington of State <br /> Highway SR-526 under Court Cause No. 93010 of the Superior Court of <br /> Snohomish County, State of Washington; and except that portion conveyed <br /> to the City of Everett by deed recorded under Recording Number <br /> 8303280307 <br /> Section 2: Any use of the property described in Section 1 inconsistent with the terms and <br /> conditions of the R-3 zoning as provided herein together with the variance granted for the subject <br /> property, shall be considered a violation of the City of Everett Zoning Code, and shall be subject <br /> to the violation and enforcement provisions thereof. <br /> Section 3: The City Clerk is hereby instructed to file a duly certified copy of this Ordinance <br /> with the Auditor of Snohomish County, Washington. <br />
