ORDINANCE NO. 2639-02 <br /> AN ORDINANCE AMENDING THE ZONING CODE TO <br /> ESTABLISH SITING REQUIREMENTS FOR SECURE <br /> COMMUNITY TRANSITION FACILITIES AND <br /> DECLARING AN EMERGENCY TO EXIST, AMENDING <br /> ORDINANCE NO. 1671-89 (AS AMENDED), ORDINANCE <br /> NO. 1847-92 AND ORDINANCE NO. 2397-99 (TITLE 19 <br /> EMC) <br /> WHEREAS, during the 2001 and 2002 legislative sessions new provisions were <br /> adopted providing for the "equitable distribution of secure community transition facilities." <br /> These are residential facilities for persons civilly committed for committing sex offenses and <br /> conditionally released to a less restrictive alternative; and <br /> WHEREAS, the State legislature was required to adopt this legislation as a result <br /> of federal court decisions holding that the State must provide additional facilities for these <br /> persons other than McNeil Island; and <br /> WHEREAS, pursuant to State law, cities are required to amend their <br /> development regulations to provide for the siting of these facilities; and <br /> WHEREAS, if cities do not establish a siting process for secure community <br /> transition facilities, as defined by RCW 71.09.020, prior to September 1, 2002, the Washington <br /> State Department of Social and Health Services can pre-empt local regulations relative to the <br /> siting of these facilities; and <br /> WHEREAS, the failure of the City to enact regulations prior to September 1, <br /> 2002, will result in the City losing control over the siting of these facilities locally; and <br />
