WHEREAS, understanding that the City is required by law to provide for these <br /> facilities, the City finds that it is best for the City to retain its right to exercise some control over <br /> the placement of these facilities rather than allowing State preemption; and <br /> WHEREAS, secure community transition facilities are deemed to be "essential <br /> public facilities" and as such, are subject to and required to comply with the adopted process for <br /> the siting of essential public facilities; and <br /> WHEREAS, the City Council finds that this ordinance is a development <br /> regulation adopted pursuant to RCW 36.70A.030 and is consistent with the City's adopted <br /> Comprehensive Plan, bears a substantial relationship to public health, safety and welfare, and <br /> promotes the best long term interests of the Everett community; and <br /> WHEREAS, an emergency does exist; <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The following definitions are hereby added to Section 4.020 of <br /> Ordinance No.1671-89 (as amended by Ordinance No. 1847-92 and other ordinances) (EMC <br /> 19.04.020-Zoning Code Definitions)to provide as follows: <br /> "Secured Community Transition Facility" means a facility, as defined in RCW <br /> 71.09.020, for the housing of sexually violent predators. <br /> "Line of sight" with respect to the siting of secure community transition facilities <br /> means the maximum unobstructed distance at which it is possible to reasonably visually <br /> distinguish and recognize individuals. For the siting of secure community transition facilities, <br /> this distance is six hundred feet (600'). However, a distance less than 600 feet may be <br /> considered if the applicant demonstrates that visual barriers exist or can be created that would <br /> reduce the line of sight to a distance less than 600 feet. <br /> - 2 <br />
