E. Existing SCTF's: In the event a SCTF is legally <br /> sited in accordance with the provisions of this title, <br /> this does not preclude any subsequent siting of any <br /> risk potential activity described in section C (1) <br /> within the line of sight <br /> F. When evaluating an application for a SCTF <br /> consideration shall also be given to those siting <br /> provisions provided in RCW 71.09.250 (8). <br /> Section 4. Severability. If any section, sentence, clause or phrase of this <br /> ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, <br /> such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other <br /> section, sentence, clause or phrase of this ordinance. <br /> Section 5. Emergency. It is necessary to pass this ordinance as an emergency. If <br /> not adopted as an emergency ordinance, the City may be preempted by the State in the regulation <br /> of the siting of secure community transition facilities. This is a public emergency ordinance <br /> necessary for the immediate preservation and protection of public health and safety. The City <br /> Council declares that an emergency exists and this ordinance shall take effect immediately. <br /> Section 6: General duty. It is expressly the purpose of this ordinance to provide <br /> for and promote the health, safety and welfare of the general public and not to create or <br /> otherwise establish or designate any particular class or group of persons who will or should be <br /> especially protected or benefited by the terms of this ordinance. Nothing contained in this <br /> ordinance is intended nor shall be construed to create or form the basis of any liability on the part <br /> of the city, or its officers, employees or agents, for any injury or damage resulting from any <br /> action or inaction on the part of the city related in any manner to the enforcement of this <br /> ordinance by its officers, employees or agents. <br /> - 5 <br />
