Section 4 of Ordinance No. 2095-95, as amended, (EMC 19.38.040.C.2), <br /> Nonconforming Structures, which reads: <br /> 2. A detached accessory structure which is accessory to a single-family dwelling or <br /> duplex that has nonconforming setbacks may be demolished and a new accessory <br /> structure may be built in the same location; provided, that the new accessory structure <br /> does not exceed twenty one feet in height, meets current building code requirements, <br /> and that the location of the nonconforming accessory structure is certified by the <br /> planning department. <br /> is hereby amended to read as follows: <br /> 2. A detached accessory structure which is accessory to a single-family dwelling or <br /> duplex that has nonconforming setbacks may be demolished and a new accessory <br /> structure may be built in the same location; provided, that the new accessory structure <br /> does not exceed 15 feet in height the height at which the structure was certified above <br /> 15 feet, meets current building code requirements, and that the location of the <br /> nonconforming accessory structure is certified by the planning department. <br /> Section 45. Section 39.070 of Ordinance No. 1671-89, as amended(EMC 19.39.070), Fences, <br /> which reads: <br /> A. Height. <br /> 1. Except as provided in subsection A.2 of this section, fences in residential zones and <br /> fences located on the common abutting property line in nonresidential zones which <br /> immediately abut residential zones shall not exceed six feet in height. Within the front <br /> yard setback areas, the maximum height shall not exceed forty-two inches, unless <br /> approved by the planning director using the review process described in EMC Title <br /> 15, Local Project Review Procedures. <br /> 24 <br />
