B. Other Federal Requirements <br /> The federal requirements set forth in 24 CFR § 92.350 are applicable to the <br /> Agency as a participant in the HOME Program. The requirements of that section <br /> include: nondiscrimination and equal opportunity; disclosure requirements; <br /> debarred, suspended or ineligible contractors; and drug free workplace. The <br /> federal nondiscrimination requirements set forth at 42 U.S.C. § 12832 and <br /> relating to race, color, religion, ethnic or national origin, gender, age, familial <br /> status, and non-disqualifying handicaps also are applicable. <br /> C. Certification Regarding Lobbying <br /> The Agency shall comply with Exhibit H, attached hereto and incorporated <br /> herein by this reference, concerning prohibitions and requirements for disclosure <br /> and certification related to lobbying. <br /> D. Limitation on Consultant Compensation <br /> The rate of compensation of certain persons providing consultant services shall <br /> be limited as provided by 24 CFR § 92.358. <br /> E. Minority Outreach <br /> The Agency shall take affirmative action to encourage the use of minorities' and <br /> women's business enterprises (hereinafter "WMBE") in connection with HOME- <br /> funded activities. In order to meet this goal, the Agency shall, for all its Project <br /> contracts funded wholly or in part with County HOME funds, demonstrate a good <br /> faith effort to attain 7.7% WMBE participation. The Agency shall submit an <br /> annual report to Snohomish County of all contracts of $25,000 or more related to <br /> the Project and funded by HOME funds. <br /> F. Affirmative Marketing <br /> The Agency shall adopt and implement affirmative marketing procedures and <br /> requirements in compliance with 24 CFR § 92.351(a). The Agency shall submit <br /> the affirmative marketing procedures and requirements to the City for its review <br /> and approval. <br /> G. Affirmative Action <br /> The Agency shall take affirmative action to overcome the effects of any prior <br /> discriminatory practice which tends on the grounds of race, color, religion, ethnic <br /> or national origin, age, handicap, or gender to exclude or limit individuals from <br /> participating in the Project, to deny them the benefits of the Project, or to subject <br /> them to discrimination under the Project. <br /> Amended HOME Loan Agreement <br /> Housing Hope's Kennedy Court Improvement Project <br /> Page 8 of 53 <br />
