remain in compliance with all HOME requirements until the completion of the <br /> HOME Compliance Period. Closeout requirements comprise all actions required <br /> to demonstrate to the City's satisfaction that all terms and conditions of the <br /> Agreement have been fulfilled, including, but not limited to, disposition of tangible <br /> property and provision of reports and data. <br /> J. Term for Expenditure of HOME Funds and Project Completion <br /> The Agency shall fully disburse the HOME funds provided under this Loan <br /> Agreement for the development of the Project in accordance with the terms <br /> hereof according to the following schedule: All HOME funds must be expended <br /> and the Project completed by December 31, 2017. <br /> K. Capitalized Terms <br /> All capitalized terms used but not defined herein shall have the meanings <br /> ascribed to them in 24 CFR Parts 91 and 92. In addition, the meanings of <br /> capitalized terms defined herein are qualified in their entirety by reference to the <br /> definitions contained in 24 CFR Part 92. <br /> L. Title Insurance <br /> Prior to the disbursement of funds under this Loan Agreement, the Agency shall <br /> provide the City with an ALTA Extended Lender's title insurance policy on the <br /> Premises in the amount of $573,298. In the event additional funds are advanced <br /> to the Agency under this Loan Agreement, prior to the disbursement of those <br /> funds, the Agency shall provide the City with an endorsement to the foregoing <br /> title insurance policy that increases the amount of the insurance to include the <br /> amount of the additional funds. <br /> Said title insurance policy shall show at the time of the execution of this Loan <br /> Agreement no liens, encumbrances, or financing instruments secured by or in <br /> any way associated with the Premises except: <br /> 1. Schedule B general exceptions listed on the title insurance policy; and <br /> 2. Any Schedule B special exceptions, if any, listed on the title insurance policy. <br /> II. PROGRAM REQUIREMENTS <br /> A. Uniform Administrative Requirements <br /> As required by 24 CFR § 92.505(b), the Agency shall conform its performance <br /> under this Agreement to the requirements of the specified OMB Circulars, as <br /> applicable, 2 CFR Part 200, and 24 CFR Part 84 as they relate to the acceptance <br /> and use of federal funds under this Agreement. <br /> Amended HOME Loan Agreement <br /> Housing Hope's Kennedy Court Improvement Project <br /> Page 7 of 53 <br />
