2. The conditions proposed, as a part of this ordinance, will protect Everett Mall <br /> Way from becoming a used car auto row and preserve land for other types of <br /> retail, commercial, and office uses. <br /> WHEREAS, the City Council fmds that this ordinance is a development <br /> regulation adopted pursuant to RCW 36.70A.030 and is consistent with the City's adopted <br /> Comprehensive Plan, bears a substantial relationship to public health, safety and welfare, and <br /> promotes the best long term interests of the Everett community; and <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section l: Ordinance No. 1671-89 as amended is hereby amended to add to Table <br /> 5.2 Nonresidential uses, Note (49) and a portion of Everett Mall Way with the following <br /> conditions: <br /> 1. The minimum lot area/size would be 108,900 square feet of 2.5 acres for <br /> vehicle sales and related/supportive uses. <br /> 2. Vehicle sales would be allowed on Everett Mall Way from Evergreen <br /> Way on the west and First Place West on the east. <br /> 3. Parking and landscaping standards would be current standards, except an <br /> upgrade on the 100th Street frontage where Type II landscaping would be <br /> required. <br /> 4. At least 25%of the vehicle sales shall be new car sales. <br /> 5. Mitigation measures would be applied to restrict noise including the <br /> prohibition of exterior speakers for music and/or annoucements. <br /> 2 <br />
