On the railroad line, which has been in existence for 100 years, there is an average <br />of 30 to 50 trains per day. However, traffic is increasing on the line. Part of the <br />increased traffic will service the Port of Everett. <br />28. Burlington Northern has proposed the project because of the increased traffic and <br />the need to provide expeditious operation of the line. <br />CONCLUSIONS <br />The ?�pl���tion is #or the approva! of a ShorQlir�� "Aa�agam�nt C��ditio�a! Use <br />Permit for the construction and installation of two standard mast signals, one <br />cantenary bridge signal, a small signal hut on existing right-of-way, and a new <br />cross-over track between the existing main line tracks on the Burlington Northern <br />right-of-way near Howarth Park, Everett, Washington, and on property more <br />particutarly described in the introduction of this document. <br />2. The subject property is designated in the Everett Shoreline Master Program as <br />Conservancy-Recreation. Railroads in a Conservancy-Recreation designated area <br />are required to have development controlled through a Conditional Use Permit. <br />3. The criteria for this permit are set forth in EMC 20.12.170. With conditions, the <br />application satisfies these criteria. <br />4. The proposed use will not be contrary to the general intent of the Shoreline Master <br />Program. It witl establish an orderly, efficient method of developing property within <br />the shoreline of the City of Everett. <br />5. The requested permit satisfies the General Regulation criteria of the Shoreline <br />Mastsr Use Program and the speci�c regulations for railroad design and <br />construction and utilities. The manner in which these criteria is satisfied has been <br />addressed in the findings of this document. - <br />6. The permit will not interfere with the normal public use of the public shoreline. No <br />access is being interrupted, and the existing pedestrian access nearby to the <br />subject property will remain. <br />7. The proposed use of the site and design of the project are compatible with other <br />permitted uses in the area. <br />8. The proposed use will cause no significant adverse effect to the shoreline <br />environment in which it is located. <br />��� <br />
