2. The City must adopt interim regulations concerning the establishing <br /> and processing of applications for adult cabarets, mini-casinos, panoram <br /> premises, public places of adult entertainment and adult use businesses in <br /> order to act as a stop-gap measure: (a) to provide the City an opportunity <br /> to study the issues concerning the siting of these uses and prepare <br /> appropriate revisions to the City's regulations; and (b) to avoid applicants <br /> possibly establishing vested rights contrary to and inconsistent with any <br /> revisions the City may make to its regulatory scheme as a result of the <br /> City's study of this matter; and <br /> 3. An emergency does exist to protect the public health, safety and <br /> welfare; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Findings of Fact. The "WHEREAS" provisions above shall <br /> constitute findings of fact and are incorporated by reference as if fully set forth herein. <br /> Section 2. Interim Regulation Established. An interim regulation is hereby <br /> established on the initiation or operation of new mini-casinos as defined in EMC <br /> 19.04.020, adult cabarets as defined in EMC 5.128.010, adult use businesses as defined in <br /> EMC 19.04.020, public places of adult entertainment as defined in EMC 5.120.020 and <br /> panoram premises as defined in EMC 5.124.020 as a principal land use or an accessory <br /> use to any existing use within the boundary of the area described in Exhibit A. <br /> Establishing such facilities within that area described in Exhibit A is prohibited during <br /> the interim regulation. For the area described in Exhibit A, no applications for building <br /> permits or land use applications, or any other permits or approvals of any kind including, <br /> but not limited to, business licenses, in any way associated with such facilities shall be <br /> accepted during the effective period of this interim regulation, no pending applications <br /> shall be processed further during the effective period of this interim regulation, and no <br /> permits shall be issued or approvals granted during the effective period of this interim <br /> regulation. <br /> Section 3. Term. The interim regulation established by this Ordinance shall <br /> terminate six (6) months after passage unless earlier repealed or renewed according to <br /> law. <br /> Section 4. Severability. Should any section, paragraph, clause or phrase of <br /> this Ordinance, or its application to any person or circumstance, be declared <br /> unconstitutional or otherwise invalid for any reason, or should any portion of this <br /> Ordinance be pre-empted by state or federal law or regulations, this shall not affect the <br /> validity of the remaining portions of this Ordinance or its application to other persons or <br /> circumstances. <br /> 5 <br />
