Thirty(30) days from the date of the County's receipt of such written <br /> objection or request, the parties agree to submit the matter to the dispute <br /> resolution process set forth in Section 8 of the Agreement. <br /> 1.4.6 Retroactive Invoicing and Payment <br /> As of the Execution Date, the County has provided Services since the <br /> beginning of the year 2013 to the City for which it has not been <br /> compensated. The County may retroactively invoice the City for its <br /> proportionate share of any Services performed since the beginning of 2013 <br /> and before the Execution Date of this Agreement. Such invoice shall <br /> describe in reasonable detail the amount of time spent by the County on <br /> which Services since 2013 and before the Execution Date and shall <br /> include a 15%Administration fee on any County labor costs. <br /> Reimbursable cost items and the cost of any materials and/or equipment <br /> used by the County in performing said services shall also be itemized on <br /> the retroactive invoice. The City shall pay the retroactive invoice within <br /> thirty(30) days of receiving same, but the City has no obligation to make <br /> payment per Section 3.1.1.4 unless the City has received the conveyance <br /> per Section 2.11 of the Agreement. Such retroactive invoicing for services <br /> provided since 2013 shall be in addition to the City's obligation to <br /> reimburse for its proportionate share of Preliminary SEPA costs incurred <br /> by the County up through December 31, 2012, as set forth in subparagraph <br /> 1.1.1 above. <br /> 1.5 Dike Connection <br /> 1.5.1 It is anticipated that the City setback dike will be constructed before the <br /> County setback dike. The City and the County setback dikes are <br /> anticipated to end at the north right of way line of 12th Street Northeast.. <br /> The Dike Connection is defined as the joint connection between the City <br /> and the County setback dikes (Dike Connection), to provide a smooth, <br /> seamless transition between the two respective dikes. <br /> 1.5.2 Responsible party for Dike Connection design and construction. <br /> (a) As set forth in the Agreement,the County shall design the Dike <br /> Connection in collaboration with the City, and cost for designing <br /> the Dike Connection shall be part of the County's setback dike <br /> design costs, and shall not be subject to reimbursement by the City. <br /> The County will provide the City with the Dike Connection design <br /> and specifications. <br /> (b) The County will include the Dike Connection in the County's bid <br /> package as for the County's setback dike construction. <br /> (c) (Omitted) . <br /> (d) Costs incurred by the constructing party building the Dike <br /> Connection, for portions that are on the other party's property, <br /> shall be subject to total reimbursement of construction cost by the <br /> other party, on whose property the dike connection is being <br /> INTERGOVERNMENTAL AGREEMENT FOR <br /> IMPLEMENTATION OF THE SMITH ISLAND RESTORATION PROJECT PAGE 26 <br />
