WHEREAS the City hired consultants to study several roadway alignment alternatives. <br /> The City considered several alternative sites for the Project. These alternatives are <br /> referenced in the Final Environmental Impact Statement for the Proposed Widening of <br /> SR 527 from 112`h Street S.E. and 132nd Street S.E. dated August 1995. These <br /> alternatives were presented to the public for comment during the Environmental Impact <br /> Study phase of the Project. <br /> WHEREAS this is the only section of SR 527 within the City that has not yet been <br /> improved and the land, property and property rights selected are those that abut Project <br /> along the existing right-of-way from 112th Street S.E. to 132nd Street S.E. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Public Use. The construction of road improvements within the vicinity of SR <br /> 527 between 112`h Street S.E. and 132nd Street S.E. will promote and enhance the public <br /> health, safety and welfare by reducing traffic counts within the SR 527 corridor between <br /> 112`h Street S.E. and 132nd Street S.E. and creating the potential for reduced traffic <br /> accidents. The Project will also provide additional benefits such as storm water run-off <br /> detention and treatment as well as pedestrian sidewalks, bicycle lanes, landscaping and <br /> lakeshore improvements, such as fishing piers, sidewalks, picnic tables, benches, and <br /> interpretive signs along the east shoreline of Silver Lake. These promote safety as well <br /> as public recreation and foster community and family ties. The Project will also promote <br /> commerce and economic development in the City of Everett and Snohomish County <br /> generally. The Project will be a part of a right-of-way owned by the City of Everett and <br /> open for use by the general public, and therefore the use of the land, property and/or <br /> property rights condemned, taken and/or appropriated by this ordinance for the <br /> construction of such Project constitutes a public use. <br /> Section 2. Public Necessity. The taking or damaging of the land, property and/or <br /> property rights, situated in the City of Everett, and legally described in Exhibits 1 — 13 to <br /> this ordinance and incorporated here by this reference (the "Property"), are necessary for <br /> development, construction, operation and maintenance of the Project. Alternative <br /> alignments have been reviewed, considered and rejected. The alignment selected best <br /> meets the requirements of the City's Comprehensive Plan and six-year Transportation <br /> Improvement Plan. The Property selected, are those abutting the existing roadway. They <br /> are necessary for development, construction, operation and maintenance of the Project. <br /> Section 3. Condemned Property. The City unsuccessfully attempted to negotiate and <br /> close the purchase of the Property (legally described in Exhibits 1 — 13) from the owners <br /> thereof. In view of the impasse reached with the property owners, the City Council of the <br /> City of Everett, after reviewing the planned construction, hereby declares that the <br /> Property (see Exhibits 1 - 13), shall be and hereby is condemned, appropriated, taken <br /> and/or damaged for the public use and purpose of constructing a special events center as <br /> described in Section 1 above.
