Waterfront Commercial designation for the property is consistent with Comprehensive Plan <br /> policies overall. <br /> Policy 1.1.3 The City shall discourage the conversion of residentially zoned areas to <br /> commercial or industrial zoning. Changes of land use designation from residential to <br /> nonresidential use shall be consistent with the criteria specified in the Land Use Element. <br /> The criteria include that the original designation was based on an erroneous assumption, in <br /> this case the property was grouped with other residential properties in the area, but it is <br /> significantly different from those properties and does nbt meet the Comprehensive plan <br /> Locational criteria for residential use. <br /> Overall the Waterfront Commercial comprehensive plan designation and zoning are <br /> appropriate for the area, since <br /> • The Comprehensive Plan locational criteria for single family detached residential housing <br /> states that "This designation is applied to areas presently developed with predominantly <br /> single family detached dwellings." The Mukilteo Tank Farm property has not been used <br /> for residential use, but has been an industrial use. <br /> • The land is waterward of the BNSF railroad line and is part of a larger property in <br /> Mukilteo that will be redeveloped with uses that include a new ferry terminal, a Sound <br /> Transit station, public access, and commercial, residential and recreational uses. Single <br /> family residential development in the area is landward of the railroad line. <br /> • The designation complies with the locational criteria for waterfront commercial <br /> designated lands. <br /> • The comprehensive SMP update provides for additional residential housing in other areas <br /> in shoreline jurisdiction (Riverfront Commercial/Urban Multi-Use area). <br /> 2. The proposal bears a substantial relation to public health, safety or welfare. <br /> The proposed rezones to Open Space and Aquatic will ensure the protection of these areas to <br /> a greater extent than existing zoning. <br /> The rezones to Park will promote the master planning of these areas that will result in <br /> additional recreational opportunities for the residents of Everett and surrounding areas. <br /> The rezone of the Mukilteo tank farm to Waterfront Commercial will provide for continued <br /> planning for this area cooperatively with other affected agencies, including the Port of <br /> Everett, Sound Transit, Washington Department of Transportation, City of Mukilteo and <br /> Tulalip Tribes. Redevelopment of the property will result in a mix of transportation, <br /> commercial, and recreational opportunities that support the needs of residents as well as state <br /> and international transportation needs. <br /> 3. The proposal promotes the best long-term interests of the Everett community. <br /> The proposed rezones to Open Space and Aquatic Zones provide more information to <br /> property owners and the public regarding the limited potential for use of those properties.
