1111 <br /> III II� U►Ill I I.I�I llhII * <br /> 0000054415 <br /> 1 ADOPTED: 08/31/16 <br /> 2 EFFECTIVE: 09/12/16 <br /> 3 <br /> 4 SNOHOMISH COUNTY COUNCIL <br /> 5 Snohomish County, Washington <br /> 6 <br /> 7 AMENDED ORDINANCE NO. 16-062 <br /> 8 <br /> 9 AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE AN INTERLOCAL <br /> 10 AGREEMENT FOR THE SMITH ISLAND RESTORATION PROJECT BY AND <br /> 11 BETWEEN SNOHOMISH COUNTY AND THE CITY OF EVERETT, INCLUDING <br /> 12 AUTHORIZING THE SURPLUS AND TRANSFER OF CERTAIN COUNTY PROPERTY <br /> 13 INTERESTS TO THE CITY OF EVERETT <br /> 14 <br /> 15 <br /> 16 WHEREAS, RCW 39.34 (Interlocal Cooperation Act) permits local governments <br /> 17 to make the most efficient use of their powers by enabling them to cooperate with other <br /> 18 localities on a basis of mutual advantage, and thereby provide facilities that meet the <br /> 19 needs of local communities; and <br /> 20 <br /> 21 WHEREAS, the County is in the process of undertaking a large scale wetland <br /> 22 restoration project, commonly known as the Smith Island Restoration Project (the <br /> 23 "Smith Island Project"), which will restore over 380 acres of estuarine/intertidal wetlands <br /> 24 in the Snohomish River Estuary, as part of a basin-wide effort to recover endangered <br /> 25 Chinook salmon and other salmonid species in the Snohomish River Basin; and <br /> 26 <br /> 27 WHEREAS, the County owns the majority (87.0%) of the Smith Island Project <br /> 28 site, and City owns property on the south end of the Smith Island Project site comprising <br /> 29 a substantial share (13.0%) of the Smith Island Project site; and <br /> 30 <br /> 31 WHEREAS, the County is responsible for the wetland restoration on the County <br /> 32 property primarily for the purpose of habitat uplift; and <br /> 33 <br /> 34 WHEREAS, the City is responsible for the wetland restoration on the City <br /> 35 property primarily for the purpose of wetland mitigation; and <br /> 36 <br /> 37 WHEREAS, certain historical and pending activities in connection with the Smith <br /> 38 Island Project have been and will be of mutual benefit to the County and the City, and <br /> 39 the County and City have agreed to share such costs by certain cost formulas, <br /> 40 depending on the activity; and <br /> 41 <br /> 42 WHEREAS, the County and City find it mutually beneficial to set forth in an <br /> 43 Interlocal Agreement certain provisions for responsibilities of the County and the City in <br /> 44 regard to the Smith Island Project in certain cases: where the County will be the lead for <br /> 45 both the City and the County; where actions may be taken jointly or may be coordinated <br /> ORDINANCE NO. 16-062 <br /> AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE AN INTERLOCAL AGREEMENT FOR <br /> THE SMITH ISLAND RESTORATION PROJECT BY AND BETWEEN SNOHOMISH COUNTY <br /> AND THE CITY OF EVERETT, INCLUDING AUTHORIZING THE SURPLUS AND <br /> TRANSFER OF CERTAIN COUNTY PROPERTY INTERESTS TO THE CITY OF EVERETT - 1 <br />
