1 between the County and City; or where either the County or the City will take separate <br /> 2 action; and <br /> 3 <br /> 4 WHEREAS, the County and City find it mutually beneficial to set forth certain <br /> 5 other provisions, including but not limited to, Dike and Drainage Design Coordination, <br /> 6 Project Management and Coordination, Access to Property, and Dispute Resolution; <br /> 7 and <br /> 8 <br /> 9 WHEREAS, shared and separate costs have been apportioned to the City and to <br /> 10 the County, and the County has and will continue to perform work that benefits the City, <br /> 11 for which $670,000 is the Maximum City Obligation; and <br /> 12 <br /> 13 WHEREAS, in order to facilitate without delay the actions needed to complete <br /> 14 the work of the Smith Island Restoration Project, it is in the public interest to authorize <br /> 15 the Director of Public Works to approve amendments to the Interlocal Agreement with <br /> 16 the City as needed, such as for construction management services for the City portion <br /> 17 of the Smith Island Restoration Project; and <br /> 18 <br /> 19 WHEREAS, the County and the City find it mutually beneficial for the County to <br /> 20 provide construction management services for City construction work on the Smith <br /> 21 Island Restoration Project that will be on City property; and <br /> 22 <br /> 23 WHEREAS, it is in the public interest to provide authorization and amount for the <br /> 24 Director of Public Works to amend this Agreement with in order to facilitate the <br /> 25 construction of the Smith Island Restoration Project; and <br /> 26 <br /> 27 WHEREAS, the City is in the process of annexing certain portions of Smith Island <br /> 28 in order to expedite its portion of the Smith Island project by bringing City-owned <br /> 29 property in unincorporated Snohomish County into the City limits of Everett; and <br /> 30 <br /> 31 WHEREAS, some dikes, levees or other property located adjacent to Union <br /> 32 Slough, between 12th Street NE and 4th Street SE are within an area the City proposes <br /> 33 to use for advanced mitigation; and <br /> 34 <br /> 35 WHEREAS, the City desires the County to quitclaim and convey property <br /> 36 interests it holds per deeds recorded under Auditor's File No. 511128 and Auditor's File <br /> 37 No. 536725 for dikes located adjacent to Union Slough, between 12th Street NE and 4th <br /> 38 Street SE and to convey any property interest the County holds in the former and <br /> 39 existing dikes being property to which the Diking District No. 5 previously conveyed its <br /> 40 interest to the City pursuant to that deed recorded under Auditor's File No. <br /> 41 200303030331; and <br /> 42 <br /> 43 WHEREAS, it is in the public interest and for support of the Smith Island <br /> 44 Restoration Project, the County Property Management Division recommends approval <br /> 45 of the surplus and transfer of certain County property interests to the City of Everett and <br /> ORDINANCE NO. 16-062 <br /> AUTHORIZING THE COUNTY EXECUTIVE TO EXECUTE AN INTERLOCAL AGREEMENT FOR <br /> THE SMITH ISLAND RESTORATION PROJECT BY AND BETWEEN SNOHOMISH COUNTY <br /> AND THE CITY OF EVERETT, INCLUDING AUTHORIZING THE SURPLUS AND <br /> TRANSFER OF CERTAIN COUNTY PROPERTY INTERESTS TO THE CITY OF EVERETT -2 <br />
