r Ordinance No. 3051-08 An Ordinance relating to Regulation of Vessels, Amending Section 3 of Ordinance No. 2834-05 (EMC 12.02.175) Whereas, Chapter 12.02 of the Everett Municipal Code(Regulation of Vessels) was amended in 2005 to provide,consistently with state law,that no person may own or operate a vessel on jurisdictional waters without valid registration and proper display of registration number and decal; and Whereas, at the time of said amendment the State law penalty for a vessel registration violation was a misdemeanor; and Whereas, since the 2005 local enactment,the State has revised the penalty for vessel registration violation to be punishable as a class 2 civil infraction; and Whereas,the City Council has been advised that the local penalty for vessel registration violation should be consistent with State law; and Whereas,the City Council has been advised that Courts established under Title 3 of the Revised Code of Washington are required to collect certain State law monetary assessments in addition to any base fine or penalty; Whereas,this Ordinance is an exercise of the City's authority to license and regulate vessels that are used within its jurisdiction; NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: Section 1: Section 3 of Ordinance No. 2834-05 (EMC 12.02.175), which reads as follows: Registration and display of registration number and decal prerequisite to ownership or operation of vessel—Exceptions—Penalties—Disposition of moneys collected. A. Except as provided in Chapter 88.02 RCW, no person may own or operate any vessel on waters subject to this chapter unless the vessel has been registered and displays a registration number and a valid decal in accordance with Chapter 88.02 RCW,except that a vessel which has or is required to have a valid marine document as a vessel of the United States is only required to display a valid decal.
