B. Except as otherwise provided in Chapter 88.02 RCW, a violation of this section is a <br /> misdemeanor punishable only by a fine not to exceed one hundred dollars per vessel for <br /> the first violation. Subsequent violations in the same year are subject to the following <br /> fines: <br /> 1. For the second violation, a fine of two hundred dollars per vessel; <br /> 2. For the third and successive violations, a fine of four hundred dollars per vessel. <br /> C. After subtraction of court costs and administrative collection fees,moneys collected <br /> under this section shall be credited to the current expense fund of the city of Everett. <br /> Is hereby amended to read as follows: <br /> Registration and display of registration number and decal prerequisite to ownership <br /> or operation of vessel—Exceptions—Penalties—Disposition of moneys collected. <br /> A. Except as provided in Chapter 88.02 RCW, no person may own or operate any <br /> vessel on waters subject to this chapter unless the vessel has been registered and displays <br /> a registration number and a valid decal in accordance with Chapter 88.02 RCW, except <br /> that a vessel which has or is required to have a valid marine document as a vessel of the <br /> United States is only required to display a valid decal. <br /> B. Except as otherwise provided in Chapter 88.02 RCW, a violation of this section is an <br /> infraction punishable by a fine of one hundred twenty-five dollars <br /> C. All Public Safety and Education Assessments (PSEA)required by State law shall be <br /> added to the base penalty described in subsection B. Remission of PSEA money shall be <br /> as set forth in State law and cannot be suspended or waived. <br /> D. Municipal Court judges and judges pro tern shall have discretion to assess additional <br /> penalties for failure to pay or respond to notices of infractions issued under this section as <br /> otherwise allowed by law. <br /> Section 2: Severability. If any section, subsection, sentence, clause,phrase or word of <br /> this ordinance should be held to be invalid or unconstitutional by a court of competent <br /> jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or <br /> constitutionality of any other section, subsection, sentence, clause, phrase or word of this <br /> ordinance. <br /> Section 3: Savings. The enactment of this ordinance shall not affect any case, <br /> proceeding, appeal or other matter currently pending in any court or before the City or in <br /> any way modify any obligation, right or liability, civil or criminal, which may exist by <br /> virtue of any of the ordinances herein amended. <br /> Section 4. Purpose. <br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety <br /> and welfare of the general public and not to create or otherwise establish or designate any <br /> particular class or group of persons who will or should be especially protected or <br /> benefited by the terms of this ordinance.
