Exhibit D <br /> DEVELOPMENT AGREEMENT <br /> THIS AGREEMENT is entered into this day of 2008, by and <br /> between Mariner Square Investments, LLC, David Allegre, Manager, 9523 32nd Street, SE, <br /> Everett, Washington 98205, and Michael Wright, 11624 51g`Ave SE, Everett, Washington <br /> 98205 (hereafter jointly termed, "The Owners"), and the City of Everett, a municipal corporation <br /> under the laws of the State of Washington(hereinafter, "City"). <br /> RECITALS <br /> A. The combined property held by the Owners is approximately 4.0 acres of real <br /> property(Exhibit A) on the east side of 19th Avenue SE, north of 116th Street SE(hereafter <br /> "Property"). Upon implementation of this Agreement the zoning will be B-2 (Community <br /> Business) subject to use limitations, and building standards specified . <br /> The Owners interest is to expand the range of uses allowed on the property while <br /> recognizing the need to limited B-2 uses in such a way as to minimize impacts on nearby <br /> residential areas. The Owners herein state, as evidenced by willingness to sign this Agreement, <br /> that they have examined all details of the financial and land use implications of this Agreement <br /> and herein state their willingness allow and encourage only those uses listed herein, and no <br /> others, unless approved by the City. The City agrees the community would benefit from such an <br /> action at this location, provided conditions found herein are met. <br />
