Section 16: Irrigation water customers will be defined as follows: "All metered water services <br /> which provide water solely for the purpose of commercial or agricultural irrigation of crops or <br /> landscaping shall be considered irrigation accounts for the purpose of water billing". <br /> Section 17: Future Rate Increases. Future increases in the water rates charged herein (except the <br /> State of Washington tax on system revenues) may be increased by the City Council resolution subject <br /> to public hearing and notice of publication thereof at least two weeks in advance of approval of said <br /> resolution. <br /> Section 18: Where the use of water is such that a portion of all the water delivered to the customer <br /> does not discharge into a City sewer due to commercial or industrial use, such as loss by evaporation <br /> or any other cause or use in manufactured products, such as ice, canned goods, beverages and the like, <br /> no sewer service charge shall be made because of water so used or lost: provided however, the water <br /> user shall provide proof as to the amount of sewage discharge and/or install a meter or other measuring <br /> device approved by the City Engineer to determine either the amount of sewage discharge or the <br /> amount of water used or lost. <br /> Section 19: Where a non-residential metered water customer can demonstrate that its consumption of <br /> water is now and will be substantially in excess of surface water impact, the Public Works Director is <br /> authorized to adjust the charges for water quality protection and enhancement to adequately reflect any <br /> excessive disparity. The burden of proof shall be on the applicant for any adjustment and adjustment <br /> shall not be retroactive. The Public Works Director shall develop criteria and procedures for such <br /> review. <br /> Section 20: The City of Everett will review the user charges at least annually and revise the rates as <br /> necessary to ensure that adequate revenues are generated to pay the costs of operation and maintenance <br /> including replacement and that the system continues to provide for proportional distribution of costs <br /> of operation and maintenance including replacement among users. <br /> Section 21: The City of Everett will notify each user at least annually of the rate being charged for <br /> operation and maintenance (including non-capital replacement) of the collection and treatment <br /> systems. <br /> Section 22: Severability. If any section, sentence, clause or phrase of this ordinance should be held to <br /> be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or <br /> unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, <br /> clause or phrase of this ordinance. <br /> 27 <br />
