e/Plfr <br /> 4110111 <br /> ORDINANCE NO. 31 !8 - 09 <br /> An Ordinance Amending Section 3(D) of Chapter 5 of Ordinance No. <br /> 2530-01 (EMC 15.20.110), Extending the Effective Period for Land Use <br /> Permits Issued under Review Process II and III <br /> WHEREAS, the City adopted Ordinance No. 2530-01 to establish Local Project Review <br /> Procedures and implement certain requirements of State law contained in RCW 36.70B; <br /> and <br /> WHEREAS, Section 3(D) of Chapter 5 of Ordinance No. 2530-01 (EMC 15.20.110) <br /> established an eighteen month effective period for approval of land use permits issued by <br /> the City using Review Process II and Review Process III; and <br /> WHEREAS, EMC 15.20.110.B provides for an extension of an additional six months by <br /> the Planning Director; and <br /> WHEREAS, the City of Everett has approved a substantial number of land use permits <br /> under Review Processes II and III that have been unable to obtain building permits due to <br /> unfavorable economic conditions; and <br /> WHEREAS, on May 21, 2008, the City Council adopted Ordinance No. 3072-08, which <br /> established the Core Residential Development and Design Standards; and <br /> WHEREAS, the City Council finds that the unusual and unprecedented economic <br /> conditions recently encountered across the nation may result in projects that would <br /> otherwise be beneficial to the City losing their vesting rights unless additional time can <br /> be allowed to secure project financing and building permits; and <br /> WHEREAS, the City Council finds that allowing additional time for approved projects <br /> to secure project financing and building permits is both necessary and beneficial to the <br /> City; <br /> NOW, THEREFORE, THE CITY DOES ORDAIN: <br /> Section 1. Section 3(D) of Chapter 5 of Ordinance No. 2530-01 (EMC 15.20.110), <br /> which reads as follows: <br />
