I <br /> 1 <br /> I 2 B. When an item of Work, as defined elsewhere in the Contract, is increased in <br /> 3 excess of 125 percent or decreased below 75 percent of the original Contract <br /> 4 quantity. For the purpose of this Section, an item of Work will be defined as any <br /> 5 item that qualifies for adjustment under the provisions of Section 1-04.6. <br /> I 6 <br /> 7 The following two new sentences are inserted at the beginning of the eighth paragraph: <br /> 8 <br /> I 9 Within 14 calendar days of delivery of the change order the contractor shall endorse <br /> 10 and return the change order, request an extension of time for endorsement or respond <br /> 11 in accordance with Section 1-04.5. The Contracting Agency may unilaterally process the <br /> 12 change order if the Contractor fails to comply with these requirements. <br /> 13 <br /> 14 The last two paragraphs are deleted. <br /> I 15 <br /> 16 This section is supplemented with the following new subsections: <br /> 17 <br /> I 18 1-04.4(2) Value Engineering Change Proposal (VECP) <br /> 19 1-04.4(2)A General <br /> 20 A VECP is a Contractor proposed change to the Contract Provisions which will <br /> 21 accomplish the projects functional requirements in a manner that is equal to or <br /> I 22 better than the requirements in the Contract. The VECP may be: (1) at a less cost <br /> 23 or time, or (2) either no cost savings or a minor increase in cost with a reduction in <br /> 24 Contract time. The net savings or added costs to the Contract Work are shared by <br /> I 25 the Contractor and Contracting Agency. <br /> 26 <br /> 27 The Contractor may submit a VECP for changing the Plans, Specifications, or other <br /> I 28 requirements of the Contract. The Engineer's decision to accept or reject all or part <br /> 29 of the proposal is final and not subject to arbitration under the arbitration clause or <br /> 30 otherwise subject to litigation. <br /> I 31 <br /> 32 The VECP shall meet all of the following: <br /> 33 <br /> I 34 1. Not adversely affect the long term life cycle costs. <br /> 35 <br /> 36 2. Not adversely impact the ability to perform maintenance. <br /> 37 <br /> I 38 3. Provide the required safety and appearance. <br /> 39 <br /> 40 4. Provide substitution for deleted or reduced Disadvantaged Business <br /> I 41 Enterprise Condition of Award Work, Apprentice Utilization and Training. <br /> 42 <br /> 43 VECPs that provide a time reduction shall meet the following requirements: <br /> I 44 <br /> 45 1. Time saving is a direct result of the VECP. <br /> 46 <br /> I 47 2. Liquidated damages penalties are not used to calculate savings. <br /> 48 <br /> 49 3. Administrative/overhead cost savings experienced by either the <br /> I 50 Contractor or Contracting Agency as a result of time reduction accrue to <br /> 51 each party and are not used to calculate savings. <br /> 52 <br /> I <br /> I AMENDMENTS TO THE 2014 STANDARD SPECIFICATIONS BOOK <br /> Revised: 8/3/15 <br />
