The Contracting Agency will require up to seven calendar days from the <br /> 2 date the data is received. <br /> I 3 <br /> 4 Contract work to be performed using contractor-provided stakes shall not begin until the <br /> 5 stakes are approved by the Contracting Agency. Such approval shall not relieve the <br /> I 6 Contractor of responsibility for the accuracy of the stakes. <br /> 7 <br /> 8 Stakes shall be marked in accordance with Standard Plan A10.10. When stakes are <br /> I9 needed that are not described in the Plans, then those stakes shall be marked, at no <br /> 10 additional cost to the Contracting Agency as ordered by the Engineer. <br /> 11 <br /> 12 Payment <br /> 13 Payment will be made in accordance with Section 1-04.1 for the following bid item when <br /> 14 included in the proposal: <br /> 15 <br /> 16 "Roadway Surveying", lump sum. <br /> 17 <br /> 18 The lump sum contract price for "Roadway Surveying" shall be full pay for all labor, <br /> I 19 <br /> 20 equipment, materials, and supervision utilized to perform the Work specified, including <br /> any resurveying, checking, correction of errors, replacement of missing or damaged <br /> 21 stakes, and coordination efforts. <br /> I 22 <br /> 23 1-05.7.RTF <br /> 24 1-05.7 Removal of Defective and Unauthorized Work <br /> 1 25 (October 1, 2005 APWA GSP) <br /> 26 <br /> 27 Supplement this section with the following: <br /> 28 <br /> 29 If the Contractor fails to remedy defective or unauthorized work within the time specified <br /> 30 in a written notice from the Engineer, or fails to perform any part of the work required by <br /> 31 the Contract Documents, the Engineer may correct and remedy such work as may be <br /> I 32 identified in the written notice, with Contracting Agency forces or by such other means <br /> 33 as the Contracting Agency may deem necessary. <br /> 34 <br /> I 35 If the Contractor fails to comply with a written order to remedy what the Engineer <br /> 36 determines to be an emergency situation, the Engineer may have the defective and <br /> 37 unauthorized work corrected immediately, have the rejected work removed and <br /> I 38 replaced, or have work the Contractor refuses to perform completed by using <br /> 39 Contracting Agency or other forces. An emergency situation is any situation when, in the <br /> 40 opinion of the Engineer, a delay in its remedy could be potentially unsafe, or might cause <br /> 41 serious risk of loss or damage to the public. <br /> I 42 <br /> 43 Direct or indirect costs incurred by the Contracting Agency attributable to correcting and <br /> 44 remedying defective or unauthorized work, or work the Contractor failed or refused to <br /> I <br /> 45 perform, shall be paid by the Contractor. Payment will be deducted by the Engineer from <br /> 46 monies due, or to become due, the Contractor.
