I <br /> 1 1-07.1.0PT1.GR1 1 <br /> 2 (March 25, 2009) <br /> 3 American Recovery and Reinvestment Act of 2009 (ARRA) Employment I <br /> 4 Report <br /> 5 The Contractor shall submit monthly reports of the number of employees actively <br /> 6 working on this project for the Contractor and all Subcontractors of every tier. The <br /> 7 reports shall include all employees actively working on this project at the jobsite, in the <br /> 8 project office, in the home office, or teleworking from a home or other alternative office <br /> 9 location; and all engineering personnel, inspectors, sampling and testing technicians, <br /> 10 and lab technicians actively performing work directly in support of this project (excluding <br /> 11 suppliers) during the reporting month. <br /> 12 <br /> 13 The report shall be prepared using Form FHWA-1589 and submitted monthly to the <br /> 14 Project Engineer. The initial report shall be submitted to the Project Engineer within 30- <br /> 15 days of execution. Subsequent reports shall be submitted to the Project Engineer no <br /> I <br /> 16 later than 10-days after the end of each report month. <br /> 17 <br /> 18 Failure by the Contractor to submit ARRA Employment Reports for the Contractor and <br /> 19 all Subcontractors of every tier shall be reason for withholding all progress payments <br /> 20 until reports are received. The cost of preparing and submitting ARRA Employment <br /> 21 Reports is incidental to the Contract. The Contractor shall include all related costs in the <br /> 22 unit Bid prices of the Contract. <br /> 23 <br /> 24 1-07.1:RTF <br /> 25 1-07.1 Laws to be Observed <br /> 26 (October 1, 2005 APWA GSP) <br /> 27 <br /> 28 Supplement this section with the following: <br /> 29 <br /> 30 In cases of conflict between different safety regulations, the more stringent regulation <br /> 31 shall apply. <br /> 32I <br /> 33 The Washington State Department of Labor and Industries shall be the sole and <br /> 34 paramount administrative agency responsible for the administration of the provisions of <br /> 35 the Washington Industrial Safety and Health Act of 1973 (WISHA). <br /> 36 <br /> 37 The Contractor shall maintain at the project site office, or other well known place at the <br /> 38 project site, all articles necessary for providing first aid to the injured. The Contractor <br /> 39 shall establish, publish, and make known to all employees, procedures for ensuring <br /> 40 immediate removal to a hospital, or doctor's care, persons, including employees, who <br /> 41 may have been injured on the project site. Employees should not be permitted to work <br /> I <br /> 42 on the project site before the Contractor has established and made known procedures <br /> 43 for removal of injured persons to a hospital or a doctor's care. <br /> 44 <br /> 45 The Contractor shall have sole responsibility for the safety, efficiency, and adequacy of <br /> 46 the Contractor's plant, appliances, and methods, and for any damage or injury resulting <br /> 47 from their failure, or improper maintenance, use, or operation. The Contractor shall be <br /> 48 solely and completely responsible for the conditions of the project site, including safety <br /> 49 for all persons and property in the performance of the work. This requirement shall <br /> 50 apply continuously, and not be limited to normal working hours.
