I <br /> 111 1 participation by DBEs even if the Bidder preferred to perform these <br /> 2 Work items as the Prime Contractor; <br /> i3 <br /> 4 4. Advertising by the Bidder in general circulation, trade association <br /> 5 minority and trade oriented, women focus publications, concerning <br /> I 6 the subcontracting or supply opportunities; <br /> 7 <br /> 8 5. Providing written notice from the Bidder to a reasonable number of <br /> 1 9 specific DBEs, identified from the OMWBE Directory of Certified DBE <br /> 10 Firms for the selected subcontracting or material supply Work, in <br /> 11 sufficient time to allow the enterprises to participate effectively; <br /> I 12 <br /> 13 6. Follow-up by the Bidder of initial solicitations of interest by contacting <br /> 14 the DBEs to determine with certainty whether they were interested. <br /> I 15 Documentation of this kind of action shall include the information <br /> 16 outlined below: <br /> 17 <br /> I 18 a. The names, addresses, telephone numbers of DBEs who were <br /> 19 contacted, the dates of initial contact, and whether initial <br /> 20 solicitations of interest were followed-up by contacting the DBEs <br /> 21 to determine with certainty whether the DBEs were interested; <br /> I22 <br /> 23 b. A description of the information provided to the DBEs regarding <br /> 24 the plans, specifications, and estimated quantities for portions of <br /> I 25 the Work to be performed; <br /> 26 <br /> 27 c. Documentation of each DBE contacted but rejected and the <br /> 28 reason(s) for that rejection; <br /> 29 <br /> 30 7. Providing, to interested DBEs, adequate information about the plans, <br /> I 31 specifications, and requirements for the selected subcontracting or <br /> 32 material supply Work; <br /> 33 <br /> I 34 8. Negotiating in good faith with the DBE firms, and not, without <br /> 35 justifiable reason, rejecting as unsatisfactory, Bids that are prepared <br /> 36 by any DBE. The DBE's standing within its industry, membership in <br /> 37 specific groups, organizations, or associations and political or social <br /> I38 affiliations - union vs. non-union employee status - are not legitimate <br /> 39 causes for the rejection or non-solicitation of bids in the Prime <br /> 40 Contractor's efforts to meet the project goal; <br /> I 41 <br /> 42 9. Advertising and making efforts to obtain DBE participation that were <br /> 43 reasonably expected to produce a level of participation sufficient to <br /> I <br /> 44 meet the goal or requirements of the Contracting Agency; <br /> 45 <br /> 46 10.
