Providing written notice from the Bidder to a reasonable number of 1 9 specific DBEs, identified from the OMWBE Directory of Certified DBE 10 Firms for the selected subcontracting or material supply Work, in 11 sufficient time to allow the enterprises to participate effectively; I 12 13 6. Follow-up by the Bidder of initial solicitations of interest by contacting 14 the DBEs to determine with certainty whether they were interested. I 15 Documentation of this kind of action shall include the information 16 outlined below: 17 I 18 a. The names, addresses, telephone numbers of DBEs who were 19 contacted, the dates of initial contact, and whether initial 20 solicitations of interest were followed-up by contacting the DBEs 21 to determine with certainty whether the DBEs were interested; I22 23 b. A description of the information provided to the DBEs regarding 24 the plans, specifications, and estimated quantities for portions of I 25 the Work to be performed; 26 27 c. Documentation of each DBE contacted but rejected and the 28 reason(s) for that rejection; 29 30 7. Providing, to interested DBEs, adequate information about the plans, I 31 specifications, and requirements for the selected subcontracting or 32 material supply Work; 33 I 34 8. Negotiating in good faith with the DBE firms, and not, without 35 justifiable reason, rejecting as unsatisfactory, Bids that are prepared 36 by any DBE. The DBE's standing within its industry, membership in 37 specific groups, organizations, or associations and political or social I38 affiliations - union vs. non-union employee status - are not legitimate 39 causes for the rejection or non-solicitation of bids in the Prime 40 Contractor's efforts to meet the project goal; I 41 42 9. Advertising and making efforts to obtain DBE participation that were 43 reasonably expected to produce a level of participation sufficient to I 44 meet the goal or requirements of the Contracting Agency; 45 46 10.
