4r <br /> A ' <br /> iY <br /> ORDINANCE NO. 2761-04 <br /> AN ORDINANCE REPEALING ORDINANCE 977-83 AND ESTABLISHING CHANGE ORDER <br /> AUTHORITY IN PUBLIC WORKS PROJECTS <br /> WHEREAS, the City adopted Ordinance 977-83, authorizing the Mayor to execute <br /> change orders in construction of public works projects within certain limits; <br /> WHEREAS, financial and industry conditions changed over the last twenty years since <br /> adoption of the ordinance; and <br /> WHEREAS, the City wishes to update change order authority to provide for a more <br /> efficient process in public works by adopting this ordinance and repealing Ordinance <br /> 977-83 in its entirety; <br /> NOW, THEREFORE, THE CITY OF EVERETT' DOES ORDAIN: <br /> Section 1. Repeal of Ordinance 977-83 <br /> Ordinance 977-83, titled "An Ordinance Authorizing the Mayor to Approve Change <br /> Orders on City of Everett Public Works Construction Projects Contracts," be and hereby <br /> is repealed. <br /> Section 2. Definitions <br /> A. "Change Order" means a written amendment or modification of a contract for the <br /> construction of a Public Work, including, but not limited to, contracts for construction of <br /> a Public Work using alternative public works processes authorized by state law, such as <br /> RCW Chap. 39.10. <br /> B. "Public Work"has the same meaning as defined in the Revised Code of <br /> Washington 39.04.010 or its successor. <br /> C. "Small Works"has the same meaning as defined in the Revised Code of <br /> Washington 39.04.155 or its successor. <br /> Section 3. Purpose <br /> The purpose of this Ordinance is to authorize the Mayor or the Mayor's designee to direct <br /> contractors to perform additional work that does not materially change the intended scope <br /> of the project and to execute Change Orders in Public Work projects under certain <br /> circumstances without prior express Council approval.
