{ <br /> ORDINANCE NO. 2766-04 <br /> AN ORDINANCE Amending The Port of Everett's <br /> North Marina Shoreline Master Program Amendment, <br /> Ordinance No. 2713-03, Incorporating Suggested Revisions From <br /> The State Department of Ecology Related to Section <br /> 4.4 Urban Maritime, Allowing Non water-dependant Uses <br /> in The North Marina Area, As Related to Ordinance <br /> No. 2600-02 (Shoreline Master Program), <br /> Ordinance No. 2021-94 (Comprehensive Plan) and <br /> Ordinance No. 1671-89 (TITLE 19 EMC) <br /> WHEREAS, the State Legislature enacted the Shoreline Management Act, requiring cities and <br /> counties throughout the state to adopt and amend, from time to time, shoreline master programs; <br /> and <br /> WHEREAS, the Growth Management Act, RCW 36.70A.580, provides that the goals and <br /> policies of the shoreline master program shall be considered an element of the City's <br /> Comprehensive Plan, and the other portions of the Shoreline Master Program shall be considered <br /> part of the City's development regulations; and <br /> WHEREAS, the Growth Management Act, RCW 36.70A.130, authorizes the City to amend the <br /> comprehensive plan in order to adopt or amend shoreline master programs at any time; and <br /> WHEREAS, attached hereto as Exhibit A is the map of that portion of the City's Shoreline area <br /> to be effected by this action; and <br /> WHEREAS, on September 17, 2003, the City Council adopted Ordinance 2713-03 attached <br /> hereto as Exhibit B, which amends the Shoreline Master Program as it pertains to the North <br /> Marina Area. <br /> WHEREAS, the State Department of Ecology (Ecology) has reviewed and responded by letter <br /> dated March 5, 2004, attached hereto as Exhibit C, to the City's latest amendment to the <br /> Shoreline Master Program as found in Ordinance No. 2713-03 ; and <br />
