{ <br /> WHEREAS,Ecology's response (Exhibit C) indicated the above referenced amendment to the <br /> Shoreline Master Program is consistent with Chapter 90.58 RCW, the Shoreline Management <br /> Act of 1971, per RCW 98.58.090 and WAC 173-26-120(7)(b)(i), so long as certain proposed <br /> changes are made, as documented in Exhibit C and incorporated herein, and <br /> WHEREAS, under RCW 90.58.090 (1) "a master program, segment of a master program, or an <br /> amendment to a master program shall become effective when approved by the department" <br /> (Department of Ecology); and <br /> WHEREAS, the City Council has conducted a public hearing to review and consider Ecology's <br /> proposed changes for final approval of the referenced amendment to the City's Shoreline Master <br /> Program; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES FIND: <br /> 1. In its March 5, 2004, letter of conditional approval of the SMP amendment (Ordinance <br /> No. 2713-03), with recommended changes (Exhibit C), Ecology states under"Summary of <br /> Issues Identified by Ecology as Relevant to Its Decision," that, "Changes that are being <br /> recommended by Ecology are for clarification and other minor purposes." <br /> 2. The suggested changes from Ecology are summarized as: <br /> (a)For footnotes under Table 5.1; make it clear that non water-oriented commercial uses <br /> are being allowed only in the North Marina Area and that the text refers the reader to the new <br /> Figure 5.1, see "(b)" below, <br /> (b) A new Figure 5.1 should be added; to show the reader where on the shoreline the <br /> amendment will be in effect, <br /> (c) Add provisions and conditions; to the "Purpose" Section of 4.4 for nonwater-oriented <br /> commercial uses, to make it consistent with the vision statement for the same Section. <br /> 3. After consideration of Ecology's recommended changes, the City Council finds that the <br /> changes proposed by Ecology for its final approval of the referenced Shoreline Master Program <br /> amendment are acceptable, in that the changes do not alter the City of Everett and Port of <br /> Everett's shared intent and vision for the subject Shoreline Jurisdiction area; <br /> 2 <br />
