1 <br /> License—Application. <br /> Application for a license to operate a go-kart track shall be filed ten (10) days prior to the <br /> opening date with the city clerk on forms provided by that official. The applicant shall <br /> also contact the police department at least ten (10) days prior to the opening date. The <br /> application shall contain the following information in addition to all requirements set <br /> forth in Chapter 5.04 of the Everett Municipal Code, and such other information deemed <br /> relevant by the city clerk: <br /> a. The proposed location of the track along with the proposed dimensions of the <br /> track, and the number of go-karts to be allowed on the track at any one time; and <br /> b. A list of all employees, including full name, date of birth, physical description, <br /> driver's license number, home address and home phone number. <br /> Section 3: Section 2 of Chapter 26 of Ordinance No. 295-74 (EMC 5.104.020), which <br /> reads as follows: <br /> Operating conditions -Equipment. <br /> A. No go-kart shall be operated with a horsepower in excess of four horsepower. <br /> B. All go-karts shall be controlled in such a manner that they shall not exceed the speed <br /> limit of twenty miles per hour and no go-kart shall be operated in excess of said speed. <br /> C. All go-karts shall be equipped with mufflers, to suppress noise, approved by the chief <br /> of police of the city. The chief of police shall approve all mufflers which effectively <br /> control noise so as not to be offensive to surrounding property owners. <br /> Be and the same is hereby amended to read as follows: <br /> Operating conditions - Equipment. <br /> A. No go-kart shall be operated with a horsepower in excess of five and one-half <br /> horsepower. <br /> B. All go-karts shall be mechanically controlled in such a manner that they shall not <br /> exceed the speed limit of twenty miles per hour and no go-kart shall be operated in excess <br /> of said speed. <br /> C. All go-karts shall be equipped with mufflers, to suppress noise, comply with <br /> applicable noise regulations, and effectively control noise so as not to be offensive to <br /> surrounding property owners. <br /> D. Only licensee's go-karts shall be allowed on the track. <br /> E. All patrons must wear safety belts and helmets that are state-approved for operation of <br /> a motor vehicle while riding in karts. <br /> F. All go-kart tracks shall have crowd control fencing around the entire track and pit <br /> maintenance area. <br /> G. No go-kart or go-kart track shall be operated in violation of any state or local law, <br /> rule or regulation. <br /> 2 <br />
