yx� <br /> ORDINANCE NO. 2787-04 <br /> An Ordinance amending the City of Everett Zoning Map, <br /> as adopted by Ordinance No. 1671-89, as amended, <br /> by rezoning a property generally located south of <br /> Southwest Everett Mall Way and east of 4th Avenue West <br /> from C-1 General Commercial with contract to <br /> C-1 General Commercial (eliminating the existing contract) <br /> WHEREAS, the City of Everett adopted a new Comprehensive Plan in August 1994, in <br /> conformance with the Growth Management Act; and <br /> WHEREAS, the Comprehensive Plan identified the subject property as 4.4 Mixed Use <br /> Commercial-Multiple Family, which is in part implemented by the C-1 General <br /> Commercial zoning; and <br /> WHEREAS, the current zoning of the subject property is C-1 General Commercial with <br /> contract; and <br /> WHEREAS, the subject property is proposed to be rezoned to C-1 General Commercial <br /> (eliminating the contract); and <br /> WHEREAS, an environmental analysis of the proposed rezone and a specific <br /> development proposal has been completed by the City of Everett in compliance with the <br /> requirements of the State Environmental Policy Act (SEPA); and <br /> WHEREAS, the City of Everett Hearing Examiner conducted a Public Hearing on April <br /> 8, 2004, and made a recommendation to approve the rezone of the subject property to the <br /> City Council eliminating the contract related to the zoning of said property; and <br /> WHEREAS, the City Council finds that the rezoning of the specific property described <br /> herein: <br /> 1. Is consistent with the city of Everett Comprehensive Plan: <br /> 2. Bears a substantial relation to public health, safety and welfare; and <br />
