3. Promotes the long-term interests of the Everett community; and 4. Mitigates any adverse impact upon existing or anticipated land uses in the immediate vicinity of the subject property through the Final Mitigated Determination of Non- Significance (SEPA#04-005); NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the City Council of the City of Everett does hereby find that the zoning change hereinafter set forth is in the best interest of the City of Everett and meets the purpose of the City of Everett Comprehensive Plan. Section 2: That the Zoning Map of the City of Everett, as established by Ordinance No. 1671-89, as amended, is hereby amended from C-1 General Commercial with contract to C-1 General Commercial (eliminating all contract provisions) on the following described property: The East 300 feet of the West 330 feet of the W %2 of the NW 1/4 of the NE I/4 of Sec. 24,T.28, R.4 E.W.M. lying South of Everett Mall Way subj. to ese PUD. Section 3: That the official map shall, upon the effective date of this Ordinance be amended by the Planning Department, as hereinabove provided, and henceforth said property shall be used in accordance with zone in which the same is now established, as provided by Everett Municipal Code (Ordinance No.1671-89 as amended). Section 4: That should any section, subsection, paragraph, sentence clause or phrase set forth in this ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or its application to any other person or situation. The City Council of the City of Everett hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. Section 5: It is expressly the purpose of this ordinance to provide for and promote the health, safety and welfare of the general public and to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this ordinance. Nothing contained in this ordinance is intended nor shall be construed to create or form the basis of any liability on the part of the City, or its officers, employees or agents, for any injury or damage, resulting from any action or inaction on the part of the City, its officers, employees or agents. Section 6: The City Clerk is hereby instructed to file the duly certified copy of this Ordinance with the County Auditor of Snohomish County, Washington.
