3. Promotes the long-term interests of the Everett community; and <br /> 4. Mitigates any adverse impact upon existing or anticipated land uses in the immediate <br /> vicinity of the subject property through the Final Mitigated Determination of Non- <br /> Significance (SEPA#04-005); <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the City Council of the City of Everett does hereby find that the zoning <br /> change hereinafter set forth is in the best interest of the City of Everett and meets the <br /> purpose of the City of Everett Comprehensive Plan. <br /> Section 2: That the Zoning Map of the City of Everett, as established by Ordinance No. <br /> 1671-89, as amended, is hereby amended from C-1 General Commercial with contract to <br /> C-1 General Commercial (eliminating all contract provisions) on the following described <br /> property: <br /> The East 300 feet of the West 330 feet of the W %2 of the NW 1/4 of the NE I/4 of Sec. <br /> 24,T.28, R.4 E.W.M. lying South of Everett Mall Way subj. to ese PUD. <br /> Section 3: That the official map shall, upon the effective date of this Ordinance be <br /> amended by the Planning Department, as hereinabove provided, and henceforth said <br /> property shall be used in accordance with zone in which the same is now established, as <br /> provided by Everett Municipal Code (Ordinance No.1671-89 as amended). <br /> Section 4: That should any section, subsection, paragraph, sentence clause or phrase set <br /> forth in this ordinance or its application to any person or situation be declared <br /> unconstitutional or invalid for any reason, such decision shall not affect the validity of the <br /> remaining portions of this ordinance or its application to any other person or situation. <br /> The City Council of the City of Everett hereby declares that it would have adopted this <br /> ordinance and each section, subsection, sentence, clause, phrase or portion thereof <br /> irrespective of the fact that any one or more sections, subsections, sentences, clauses, <br /> phrases or portions be declared invalid or unconstitutional. <br /> Section 5: It is expressly the purpose of this ordinance to provide for and promote the <br /> health, safety and welfare of the general public and to create or otherwise establish or <br /> designate any particular class or group of persons who will or should be especially <br /> protected or benefited by the terms of this ordinance. Nothing contained in this <br /> ordinance is intended nor shall be construed to create or form the basis of any liability on <br /> the part of the City, or its officers, employees or agents, for any injury or damage, <br /> resulting from any action or inaction on the part of the City, its officers, employees or <br /> agents. <br /> Section 6: The City Clerk is hereby instructed to file the duly certified copy of this <br /> Ordinance with the County Auditor of Snohomish County, Washington. <br />
