R <br /> e9"'irm.Jim <br /> Nitiggi <br /> ORDINANCE NO. 2791-04 <br /> AN ORDINANCE providing for the vacation of 39th <br /> Street, East of Rucker Avenue and West of Hoyt Avenue, <br /> together with that portion of the alley in Block 4, Plat of <br /> Climax Land Company's First Addition, abutting Lots 15, 16, <br /> 17, and 18 <br /> WHEREAS, the City Council of the City of Everett, did by Resolution No. 5495 <br /> duly adopt and fix the 21st day of July, 2004 at 6:30P.M., as the date of public hearing; <br /> and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said Resolution has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly <br /> presented; and <br /> WHEREAS, a review of the street network and traffic conditions in the vicinity of <br /> the proposed vacation indicate no significant negative transportation impact would be <br /> caused by the vacation of the street and the portion of the alley as proposed in the <br /> vacation; and <br /> WHEREAS, the petitioners applied for said right of way vacation after the City of <br /> Everett's adoption of Resolution No. 5083 amending the compensation requirements <br /> for right of way vacations; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said <br /> right-of-way resolved to be vacated should be vacated pursuant to the terms and <br /> conditions of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> The following described right-of-way: <br /> BEGINNING at the Southwest corner of Lot 16, Block 4, Plat of Climax <br /> Land Company's First Addition, according to the plat there of, recorded in <br /> Volume 4 of Plats, Page 21, records of Snohomish County, Washington; <br /> THENCE, East along the South line of said Lot 16 to the Southeast corner <br /> thereof; THENCE, North along the East line of said Lot16, and continuing <br /> North along the East line of Lot 15 to the Northeast corner there of; <br /> THENCE, East along the Easterly projected North line of said Lot 15 to the <br /> Northwest corner of Lot 18 of said block; THENCE, South along the West <br />
