<br /> be and the same is hereby vacated pursuant to the conditions set forth in this

<br /> Section 2:
<br /> The City of Everett shall not be responsible nor liable for storm drainage runoff resulting
<br /> from existing drainage patterns as established on City right-of-way that may currently, or
<br /> in the future, go over, under or across the above described property in Section 1 herein.
<br /> Section 3:
<br /> The City of Everett hereby retains a temporary easement to construct, reconstruct,
<br /> operate, maintain, repair, and replace all utilities under, over, and across the vacated
<br /> rights of way, legally described as follows:
<br /> BEGINNING at the Southwest corner of Lot 16, Block 4, Plat of Climax
<br /> Land Company's First Addition, according to the plat there of, recorded in
<br /> Volume 4 of Plats, Page 21, records of Snohomish County, Washington;
<br /> THENCE, East along the South line of said Lot 16 to the Southeast corner
<br /> thereof; THENCE, North along the East line of said Lot16, and continuing
<br /> North along the East line of Lot 15 to the Northeast corner there of;
<br /> THENCE, East along the Easterly projected North line of said Lot 15 to the
<br /> Northwest corner of Lot 18 of said block; THENCE, South along the West
<br /> line of said Lot 18, and continuing South along the West line of Lot 17 to
<br /> the Southwest corner there of; THENCE, East along the South line of said
<br /> Lot 17 to the Southeast corner there of; THENCE, South along the
<br /> Southerly projected East line of said Lot 17 to the Northeast corner of Lot
<br /> 32, Block 5 of said plat; THENCE, West along the North line of said Lot
<br /> 32, and the Westerly projection thereof to the Northwest corner of Lot 1 of
<br /> said Block 5; THENCE, North along the Northerly projection of the West
<br /> line of said Lot 1 to the Southwest corner of Lot 16, Block 4 of said plat,
<br /> and the POINT of BEGINNING.
<br /> The City of Everett further retains the right to grant to public and private utilities the right
<br /> to construct, reconstruct, operate, maintain, repair, and replace existing or proposed
<br /> utility lines including, but not limited to, cable, telephone, gas, and electrical under, over,
<br /> and across the property described above; provided, however, such easements shall not
<br /> interfere with the Everett Clinic's use of the vacated area.
