WHEREAS, Ordinance No. 557-78 should be amended to reflect the change in <br /> the rate of the sales tax; and <br /> WHEREAS,the Washington State Department of Revenue is required to give <br /> notice of this increase in sales tax beginning October 15, 2004; <br /> NOW THEREFORE THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1 of Ordinance No. 557-78 (3.50.010 EMC) which reads: <br /> The local sales and use tax for transit purposes, as conditionally approved by the <br /> city council in Ordinance 523-78, is established and imposed within the city at the rate of <br /> three-tenths of one percent of the selling price, in the case of the sales tax, or value of the <br /> article used, in the case of the use tax. <br /> is hereby amended to read: <br /> The local sales and use tax for transit purposes is established and imposed within <br /> the city at the rate of six-tenths of one percent of the selling price, in the case of the sales <br /> tax, or value of the article used, in the case of the use tax. <br /> Section 2. Section 5 of Ordinance No. 557-78 (3.50.050 EMC) which reads: <br /> The city council reserves authority to adjust the above established sales and use <br /> tax rate, but not so as to exceed a maximum rate of.3 percent without further approval by <br /> the voters of the city. <br /> is hereby amended to read: <br /> The city council reserves authority to adjust the above established sales and use <br /> tax rate, but not so as to exceed a maximum rate of.6 percent without further approval by <br /> the voters of the city. <br /> Section 3. Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase set <br /> forth in this ordinance or its application to any person or situation be declared <br /> unconstitutional or invalid for any reason, such decision shall not affect the validity of the <br /> remaining portions of this ordinance or its application to any other person or situation. <br /> The City Council hereby declares that it would have adopted this ordinance and each <br /> 2 <br />
