5. As sites are redeveloped,unnecessary improvements within shoreline jurisdiction should <br /> be removed. Permeable surfaces and buffers along rivers, wetlands, lakes and Port <br /> Gardner Bay should be restored to the extent practicable. Buffers and restoration should <br /> be provided consistent with EMC I9.33D.360-590 or 19.37, as applicable.. <br /> SECTION 9: Policy 15 of Section 3.9 of the Shoreline Master Program, Exhibit A to Ordinance <br /> No. 2600-02, as amended(Section II.I of Chapter 3 Shoreline Land Use Element of the <br /> Comprehensive Plan),which currently reads as follows: <br /> 15. The City should monitor and analyze the cumulative impacts of development permitted in <br /> shoreline areas, including development exempt from Shoreline Substantial Development <br /> Permit requirements. Where impacts are occurring beyond that anticipated, the City <br /> should revise the Master program to address the cumulative impacts, and/or revise the <br /> conditions of approval of developments as allowed by 19.37 (including buffers, <br /> compensation ratios, the detailed design of compensation and restoration projects, etc.)to <br /> address the new information. <br /> IS HEREBY AMENDED TO READ AS FOLLOWS <br /> 15. The City should monitor and analyze the cumulative impacts of development permitted in <br /> shoreline areas, including development exempt from Shoreline Substantial Development <br /> Permit requirements. Where impacts are occurring beyond that anticipated, the City <br /> should revise the Master program to address the cumulative impacts, and/or revise the <br /> conditions of approval of developments as allowed by 19.33D.360-590 and19.37 <br /> (including buffers, compensation ratios, the detailed design of compensation and <br /> restoration projects, etc.) to address the new information. <br /> SECTION 10: Section 3.9 of the Shoreline Master Program, Exhibit A to Ordinance No. 2600- <br /> 02, as amended (Section II.I of Chapter 3 Shoreline Land Use Element of the Comprehensive <br /> Plan),is amended by the addition of the following policy: <br /> 16. Restoration should be encouraged by reducing hardships on property owners caused <br /> when a shoreline restoration project shifts shoreline management act jurisdiction into <br /> areas that had not previously been regulated under the act or shifts the location of <br /> required shoreline buffers. <br /> SECTION 11: Regulation 1 of Section 3.9 of the Shoreline Master Program, Exhibit A to <br /> Ordinance No. 2600-02, as amended, (EMC 19.33D.090)which currently reads as follows:: <br /> 1. All development activities shall comply with the City's Environmentally Sensitive Area <br /> Ordinance, EMC 19.37, in effect on March 21, 2001, and Planning Director <br /> Interpretation No. 2-2000, Interim Procedures, Endangered Species Act Listing for <br /> Chinook Salmon and Bull Trout, unless more stringent requirements are adopted by City <br /> Council subsequent to that date. <br /> IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> 16 <br />
