• Section 6- Shoreline Modification Activities Policies and Regulations <br /> • Section 7 -Definitions <br /> • Appendix A-Documents Incorporated by Reference,including: <br /> EMC 19.38 Nonconforming Uses, Buildings and Lots <br /> EMC 19.30 Floodplain Overlay Districts and Regulations <br /> Comprehensive Plan Goals, Objectives, and Policies for Environmentally Sensitive Areas <br /> EMC 19.37 Environmentally Sensitive Areas and Applicable Definitions in EMC 19.04 <br /> Planning Director Interpretation No. 2-2000: Interim Procedures, Endangered <br /> • The Snohomish Estuary Wetland Integration Plan(SEWIP) including the SEWIP Salmon <br /> Overlay. <br /> Master Program Policies. The portions of the SMP that are not shoreline use regulations or <br /> administrative provisions are incorporated as the shoreline element of the Comprehensive Plan. <br /> These policies shall provide guidance in the interpretation of the use regulations in Section 33D <br /> —Shoreline Overlay District of the Everett Zoning Code. <br /> Master Program Regulations. The following Sections of the SMP shall constitute Section 33D— <br /> Shoreline Overlay District in the Everett Zoning Code: <br /> • Section 2 <br /> • Those provisions designated as "regulations" in Sections 3 though 6 <br /> • Figures 4.1 through 4.23 <br /> • Definitions in Section 7. <br /> Revisions to Section 33D of the Zoning Code shall be processed as shoreline master program <br /> amendments. <br /> In addition, the following development regulations have been incorporated by reference and <br /> included in Appendix A of the SMP: <br /> • EMC 19.30 Floodplain Overlay Districts and Regulations <br /> • Comprehensive Plan Goals, Objectives, and Policies for Environmentally Sensitive Areas <br /> • EMC 19.37 Environmentally Sensitive Areas and Applicable Definitions in EMC 19.04 <br /> • Planning Director Interpretation No. 2-2000: Interim Procedures, Endangered Species Act <br /> (ESA) Listing for Chinook Salmon and Bull Trout <br /> Generally, revisions to the development regulations in Appendix A that are intended to apply in <br /> the city's shoreline zone shall be processed as shoreline master program amendments. <br /> Otherwise,the version of a development regulation in Appendix A that has been approved <br /> through shoreline master program adoption process shall apply in shoreline zones. In the event <br /> the city adopts revisions to these development regulations, the city may apply regulations that <br /> offer the greatest protection of sensitive shoreline resources, even if the revised regulations are <br /> not formally incorporated into Appendix A of the SMP. The City may at its discretion process <br /> such revisions as shoreline master program amendments. The intent is to update Appendix A <br /> formally at the time substantial updates to the SMP are processed. <br /> 7 <br />
