elliamImigi <br /> ORDINANCE NO. 3133-09 <br /> AN ORDINANCE relating to Inhaling of Toxic Fumes, amending Section 110 of <br /> Ordinance No. 1145-85 (Chapter 10.40 EMC). <br /> WHEREAS, Chapter 10.40 of the EMC currently prohibits intentional <br /> smelling/inhaling of glue, cement or other adhesives that contain chemical compounds; <br /> and <br /> WHEREAS,the purpose of the prohibitions in EMC Chapter 10.40 is to penalize <br /> non-medical use of inhalants, as recreational drugs which are used for their intoxicating <br /> effect; and <br /> WHEREAS, abusers of inhalants inhale chemical vapors from a variety of <br /> substances that are not encompassed by the current prohibitions of EMC Chapter 10.40; <br /> and <br /> WHEREAS, State law has a more comprehensive definition of the crime related to <br /> intentional, non-medical inhaling; and <br /> WHEREAS, the Everett City Council deems it appropriate for the Everett Criminal <br /> Code to be consistent with State law in this area; <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 110 of Ordinance No. 1145-85 (EMC 10.40.010),which reads as <br /> follows: <br /> Glue sniffing. <br /> A. It is unlawful to intentionally smell or inhale the fumes from any glue, cement or <br /> other adhesive containing one or more of the following chemical compounds: acetone, an <br /> acetate, benzene, butyl alcohol, ethyl alcohol, ethylene, dichloride, isopropyl alcohol, <br /> methyl alcohol, methyl ethyl ketone, pentachlorophenol, petroleum ether or toluene, for <br /> the purpose of becoming intoxicated, inebriated, excited or stupefied; provided, this <br /> section shall not be construed as applying to the inhalation of any anesthesia for medical <br /> or dental purposes. <br />
