B. Glue sniffing is a misdemeanor, and shall be punished by a fine not to exceed one <br /> thousand dollars. <br /> Is hereby amended to read as follows: <br /> Unlawful Inhalation of Toxic Fumes. <br /> A. It is unlawful for any person to intentionally smell or inhale the fumes of any <br /> substance containing a solvent having the property of releasing toxic vapors or fumes, or <br /> to induce any other person to do so, for the purpose of causing a condition of, or inducing <br /> symptoms of intoxication, elation, euphoria, dizziness, excitement, irrational behavior, <br /> exhilaration, paralysis, stupefication, or dulling of the senses of the nervous system, or <br /> for the purpose of, in any manner, changing, distorting, or disturbing the audio, visual, or <br /> mental processes; provided, this section shall not be construed as applying to the <br /> inhalation of any anesthesia for medical or dental purposes. <br /> B. Unlawful Inhalation of Toxic Fumes is a misdemeanor, and, upon conviction <br /> thereof, shall be punished by a fine not to exceed one hundred dollars or by imprisonment <br /> for not more than thirty days, or by both. <br /> Section 2: Section 110 of Ordinance No. 1145-85 (EMC 10.40) is hereby amended <br /> by the addition of the following section: <br /> Possession of certain substances prohibited. <br /> A. No person may, for the purpose of violating EMC 10.40.010, use, or possess for <br /> the purpose of so using, any substance containing a solvent having the property of <br /> releasing toxic vapors or fumes. <br /> B. Possession of certain substances in violation of Section 2.A of this Ordinance is a <br /> misdemeanor, and, upon conviction thereof, shall be punished by a fine not to exceed one <br /> hundred dollars or by imprisonment for not more than thirty days, or by both. <br /> Section 3: Section 110 of Ordinance No. 1145-85 (EMC 10.40) is hereby amended <br /> by the addition of the following section: <br /> Sale of certain substances prohibited. <br /> A. No person may sell, offer to sell, deliver, or give to any other person any <br /> container of a substance containing a solvent having the property of releasing toxic <br /> vapors or fumes, if he has knowledge that the product sold, offered for sale, delivered, or <br /> given will be used for the purpose set forth in EMC 10.40.010. <br /> B. Selling, offering to sell, delivering or giving another person any container of a <br /> substance in violation of Section 3.A of this Ordinance is a misdemeanor, and, upon <br /> conviction thereof, shall be punished by a fine not to exceed one hundred dollars or by <br /> imprisonment for not more than thirty days, or by both. <br /> 2 <br />
