"IP .ar <br /> ORDINANCE NO. 3172-10 > > <br /> An Ordinance Establishing an Interim Regulation to Allow the Creation of Zero- of-Line Fee <br /> Simple Lots in the R-3L, R-3 and R-4 zones located outside the Core Residential area. <br /> WHEREAS, the City Council finds the following: <br /> 1. The Everett Zoning Code allows the development of single family attached (townhouse) <br /> dwellings in the R-1A, R-2A, R-3L, R-3 and R-4 residential zones located outside the <br /> Core Residential Area; and <br /> 2. In such zones, single family attached dwelling developments are required to comply with <br /> the Multiple Family Development Standards of EMC Chapter 19.15 and the Multiple <br /> Family Design Guidelines of Resolution No. 4618; and <br /> 3. The R-1A and R-2A zones allow the creation of fee simple lots for single family attached <br /> dwelling developments in zero lot line subdivisions with no minimum lot area or lot <br /> width requirements; and <br /> 4. The R-3L, R-3 and R-4 zones have a minimum lot area requirement of 5,000 square feet <br /> and do not allow the creation of lots suitable for zero-lot-line townhouse developments; <br /> and <br /> 5. The Everett Growth Management Comprehensive Plan contains numerous policies <br /> supporting measures to increase the opportunity for owner-occupied housing; and <br /> 6. Single family attached dwellings in multiple family zones are able to be sold to individual <br /> homeowners through a condominium conveyance process; and <br /> 7. Representatives of the real estate lending industry have indicated that recent changes to <br /> lending regulations and practices have made the conveyance of single family attached <br /> townhouse units through the condominium conveyance process infeasible; and <br /> 8. There are existing single family attached townhouse developments constructed in Everett <br /> in multiple family zones that were intended to be sold using the condominium <br /> conveyance process that are, due to the changes to lending regulations and practices, <br /> unable to be sold as originally intended to individual homeowners; and <br /> 9. The City does allow zero-lot-line townhouse developments in the R-1A and R-2A zones <br /> to be subdivided into fee simple lots, provided the development meets the multiple family <br /> development standards of EMC Chapter 19.15 and design guidelines of City Council <br /> Resolution No. 4618; and <br />
