WHEREAS, the City Council concludes: <br /> 1. An interim change to the City's zoning development standards for minimum lot area, lot <br /> width and lot depth in the R-3L, R-3 and R-4 zoned areas located outside the Core <br /> Residential Area would allow for existing, completed single family attached <br /> developments to be subdivided and sold to individual homeowners; and <br /> 2. Establishing an interim regulation for approximately one year will allow the City time to <br /> conduct a review to determine if the amendment of the minimum lot area and width <br /> standards to allow zero-lot-line townhouse developments in multiple family zones would <br /> be in the best long term interests of the City; and <br /> 3. The proposed interim regulation is consistent with the policies of the Everett Growth <br /> Management Comprehensive Plan related to increasing the opportunities for owner <br /> occupied housing. <br /> NOW, THEREFORE, THE CITY DOES HEREBY ORDAIN: <br /> SECTION 1: Notwithstanding the provisions of Title 19 EMC (Ordinance No. 1671-89 as <br /> amended), an interim zoning regulation is established to allow existing single family attached <br /> dwellings, as defined by EMC 19.04, to be subdivided into fee simple zero-lot-line lots that do <br /> not otherwise meet the minimum lot area, lot width or lot depth standards of the zone in which <br /> they are located, provided they meet all of the following: <br /> a) the dwellings are located in buildings with 3 or more dwelling units attached by a <br /> common wall or walls; and <br /> b) the dwellings are located in the R-3L, R-3 and R-4 zones outside the Core <br /> Residential Area; and <br /> c) the dwellings meet all applicable building codes and City development standards for <br /> access and utilities; and <br /> c) the dwellings meet the multiple family development standards of EMC Chapter <br /> 19.15 and design guidelines of City Council Resolution No. 4618; <br /> SECTION 2: This interim regulation shall be effective for one year from the effective date of <br /> this Ordinance. Staff is hereby directed during the interim effective period to develop and <br /> implement a work plan to review the existing zoning regulations to determine if it is in the best <br /> long-term interests of the Everett community to extend these standards or similar standards to <br /> new single family attached dwelling developments beyond the interim effective period. <br /> Section 3: Severability. Should any section, subsection, sentence, clause, phrase or word of <br /> this Ordinance be held to be invalid or unconstitutional by a court of competent jurisdiction, or <br /> otherwise invalid for any reason, or should any portion of this Ordinance be pre-empted by state <br />
