iiir Exhibit D DEVELOPMENT AGREEMENT THIS AGREEMENT is entered into this /9 ) day of _ udi 2010,by and between Everett Gospel Mission(hereafter termed, "the Mission"), and the City of Everett, a municipal corporation under the laws of the State of Washington(hereinafter"the City"). RECITALS A. The Mission owns a single family residential parcel of land at 2222 52nd Street in the Lowell Neighborhood(hereafter"the property") which is legally described as in Exhibit B; B. The purpose for the requested rezone is to rezone the property allow the Mission to use the single family home and any other associated structures on the property named above as an office space in support of the nearby Woman and Children's Center, assuming appropriate conditions as provided herein are met; C. Upon implementation of this Agreement the zoning will be B-2 (Exhibit A) subject to limitations found herein; D. Due to the wide range of uses allowed in the B-2 (Community Business) zone, and the potential for negative impacts on nearby residential properties,there needs to be an assurance provided by the Mission to the City, that the potential for such impacts will not arise as a result of the changed zone and intended new use of the property; E. This Agreement sets forth the conditions of use of the property and its appearance;
