iiir <br /> Exhibit D <br /> DEVELOPMENT AGREEMENT <br /> THIS AGREEMENT is entered into this /9 ) day of _ udi 2010,by and between <br /> Everett Gospel Mission(hereafter termed, "the Mission"), and the City of Everett, a municipal <br /> corporation under the laws of the State of Washington(hereinafter"the City"). <br /> RECITALS <br /> A. The Mission owns a single family residential parcel of land at 2222 52nd Street in the <br /> Lowell Neighborhood(hereafter"the property") which is legally described as in Exhibit B; <br /> B. The purpose for the requested rezone is to rezone the property allow the Mission to use <br /> the single family home and any other associated structures on the property named above as an office <br /> space in support of the nearby Woman and Children's Center, assuming appropriate conditions as <br /> provided herein are met; <br /> C. Upon implementation of this Agreement the zoning will be B-2 (Exhibit A) subject to <br /> limitations found herein; <br /> D. Due to the wide range of uses allowed in the B-2 (Community Business) zone, and the <br /> potential for negative impacts on nearby residential properties,there needs to be an assurance provided <br /> by the Mission to the City, that the potential for such impacts will not arise as a result of the changed <br /> zone and intended new use of the property; <br /> E. This Agreement sets forth the conditions of use of the property and its appearance; <br />
