. <br /> F. This Agreement is entered into pursuant to RCW 36.70B.170, 180, and 190. The purpose <br /> of this Agreement is to ensure use of the property and its residential appearance will in intent and fact <br /> comply with the provisions found herein. <br /> PART ONE—PROPERTY USE <br /> 1.1 SEPA. The provisions of this Agreement are subject to the City's SEPA Determination(09- <br /> 030), which is incorporated herein by reference. <br /> 1.2 Restricted Use. Pursuant to City of Everett Ordinance No. 3186-10 ,the property is <br /> zoned B-2 (Community Business) and is restricted to office use only, and uses allowed in the R-2 zone. <br /> No other uses associated with the B-2 zone specifically will be permitted. <br /> 1.3 The structure(s), yard and parking on the property shall retain, or if replaced, shall appear to <br /> be residential in function and appearance, including the structure(s),materials, roof pitch, and other <br /> image cues commonly associated with single family residential use. <br /> 1.4 No signage shall be placed on the exterior of the structure(s) or anywhere on the subject <br /> property. <br /> PART TWO—TERMS AND CONDITIONS <br /> 2.1 Effective Date—Revisions. This Agreement shall not become effective until it is fully <br /> executed. The Mission shall be entitled to apply for a major revision to this Agreement under the same <br /> rules, regulations and fee provisions governing rezones in affect at the time of such application, as if the <br /> Mission were starting from anew. <br /> 2 <br />
