ORDINANCE NO. 3 2 0 4-10 <br /> Pa <br /> An Ordinance Rezoning Property Located <br /> on the East side of Airport Road, • <br /> South of 112th Street, from M-M (Business Par ! /-7,!,� s=' / / <br /> to C-2 (Heavy Commercial-Light Industrial) <br /> with a Development Agreement, <br /> Amending Ordinance No. 1671-89 (as amended) <br /> WHEREAS, on June 28, 2010 Earth Holdings, LLC submitted a Rezone Application to the City <br /> of Everett Planning Department; and <br /> WHEREAS,Earth Holdings, LLC proposes to rezone the subject property from M-M (Business <br /> Park)to C-2 (Heavy Commercial/Light Industrial); and <br /> WHEREAS,the requested C-2 rezone is consistent with the current Comprehensive Plan <br /> Designation of 5.3, Light Industry as shown in the Comprehensive Plan Implementation section <br /> of the Everett Comprehensive Plan (Land Use Element, Section VI,A); and <br /> WHEREAS, on September 23, 2010 a public hearing on the requested rezone was held before <br /> the Hearing Examiner of the City of Everett; and <br /> WHEREAS, on October 7, 2010 the Everett Hearing Examiner issued Findings and <br /> Recommendations in the matter of the application of Earth Holdings, LLC for approval of a <br /> rezone (Airport Road Rezone); and <br /> WHEREAS,the Hearing Examiner recommended that the requested rezone of the property on <br /> the east side of Airport Road, south of 112th Street, immediately west of Walmart(west of <br /> Evergreen Way and East of Airport Road), and more particularly described in the application, be <br /> rezoned from an M-M Business Park zoning designation to a C-2, Heavy Commercial/Light <br /> Industrial zoning designation subject to a Development Agreement. The requested rezone is <br /> consistent with the goals and policies of the City of Everett's Comprehensive Plan designation of <br /> the property as 5.3, Light Industry; <br /> WHEREAS, THE EVERETT CITY COUNCIL FINDS: <br /> 1. The sole purpose for the requested rezone is to rezone the subject property from M-M to <br /> C-2 which is consistent with the current Comprehensive Plan Designation of 5.3 Light <br /> Industry; <br /> 2. To allow the proposed rezone,the City needs to change the zoning map for the subject <br /> property from M-M to C-2; <br /> 3. The public health, safety and welfare would be provided for by the proposal only if the <br /> rezone were implemented by a City development agreement; and <br /> 1 <br />
