4. The proposed rezone promotes the best long term interest of the Everett Community only if <br /> the proposal is supported through use of a Development Agreement that will provide <br /> compliance with the conditions specified herein; <br /> WHEREAS CITY COUNCIL CONCLUDES: <br /> 1. The public health, safety and welfare would be provided for by allowing Earth Holdings, <br /> LLC to rezone the subject site from M-M (Business Park)to C-2) Light Industrial/Heavy <br /> Commercial). The proposed rezone is consistent with the Everett Comprehensive Plan. <br /> 2. The proposed rezone promotes the best long-term interest of the Everett Community <br /> because the rezone site must be developed in accordance with a Development Agreement <br /> and Binding Site Plan. <br /> 3. The proposed rezone mitigates any adverse impacts upon existing or anticipated land uses <br /> in the immediate vicinity of the subject property through the implementation of the <br /> Development Agreement. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Approval of Rezone. <br /> Section 2.020 of Ordinance No. 1671-89, as amended(EMC 19.02.020), is hereby amended as <br /> follows: <br /> The zoning of the subject site is hereby changed from M-M (Business Park) to C-2 (Heavy <br /> Commercial/Light Industrial), as depicted in Exhibit B, and as legally described in Exhibit A, <br /> subject to conditions stated herein, and the Development Agreement attached hereto and <br /> incorporated herein as Exhibit C. <br /> Section 2: Conditions of Approval <br /> 1. Use of the site and the current or future structure(s) on it shall be subject to conditions and <br /> requirements of the Development Agreement attached hereto as Exhibit C and incorporated <br /> herein by reference. <br /> 2. The intent of the conditions of this Ordinance and the Development Agreement is for an <br /> integrated development of all parcels of land on the rezone site in order to reduce traffic impacts <br /> along Airport Road and to reduce environmental impacts to the on-site critical areas. <br /> 3. The Mayor is hereby authorized to execute the Development Agreement(Exhibit C). <br /> 2 <br />
