20. Notwithstanding additional regulations imposed herein, there still <br /> remain adequate locations outside of the areas within Map #15-1 for the <br /> uses specified herein to locate within the City without the more rigorous <br /> review process; and <br /> 21. RCW 35.63.200 and RCW 36.70A.390 and the City of Everett <br /> Charter, Article III, authorize the Council to enact interim regulations on <br /> land use matters to preserve the status quo while new plans or <br /> development standards are considered and prepared; and <br /> 22. The Council wishes to establish necessary and appropriate review <br /> procedures on an interim basis as a stopgap measure enabling the City to <br /> consider whether additional land use regulations are necessary and <br /> appropriate, and adopt such regulations as necessary; and <br /> 23. The adoption of this Ordinance is exempt from the threshold <br /> determination and environmental impact statement requirements of the <br /> State Environmental Policy Act, RCW 43.21C, pursuant to WAC 197-11- <br /> 880 and Everett Municipal Code, Section 20.04.030; and <br /> WHEREAS,the City Council does conclude: <br /> 1. The City does have the authority to establish interim regulations; and <br /> 2. The City must adopt interim regulations concerning the establishing <br /> and processing of applications for food banks, plasma donation centers, <br /> tattoo parlors, body piercing, video game arcades, social service agencies, <br /> parking lots, churches, single room occupancy residences, teen clubs and <br /> community centers in order to act as a stop-gap measure: (a) to provide the <br /> City an opportunity to study the issues concerning the siting of these uses <br /> and prepare appropriate revisions to the City's regulations; (b) to avoid <br /> applicants possibly establishing vested rights contrary to and inconsistent <br /> with any revisions the City may make to its regulatory scheme as a result <br /> of the City's study of this matter; and (c) to establish an interim process <br /> wherein applicant's may still seek approval of these uses subject to <br /> meeting the evaluation criteria established in this ordinance; and <br /> 3. An emergency does exist to protect the public health, safety and <br /> welfare; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 3 <br />
